32.1048 Military court; contempt power; punishment.Sec. 48.
A military court may punish for contempt an individual subject to this code who willfully and unlawfully refuses to be sworn or to affirm as a witness, or who refuses to answer a legal or proper question, or who uses a menacing word, sign, or gesture in the court's presence, or who disturbs the court proceedings by riot or disorder. The punishment for contempt in a summary court-martial proceeding must be confinement for not more than 25 days or a fine of not more than $500.00, or both. The punishment for contempt in any other military court must be confinement for not more than 100 days or a fine of not more than $2,500.00, or both.
