SUMMARY OF SENATE BILL 87 as introduced 1-17-95:

 

The bill would amend the Aeronautics Code to lower from .04% to .02% the blood alcohol level at which a person is prohibited from operating an aircraft over or upon the lands or waters of the State; and the level at which it is presumed that the operator was under the influence of intoxicating liquor if it is shown by chemical analysis that there was, at the time, that level of alcohol in the operator’s blood.

 

Under the Code, a first violation is a misdemeanor punishable by up to 90 days’ imprisonment and/or a fine of between $100 and $500, plus prosecution costs.  The prohibitions apply to both licensed and unlicensed pilots. Penalties are increased for second and third offenses.

FISCAL IMPACT

 

The bill would have no fiscal impact on the State, and possibly a minimal impact on local government.

 

If the reduction in the allowable blood alcohol resulted in increased convictions of violators, then local government could incur additional costs for prosecuting and sanctioning these offenders.
