SUMMARY OF HOUSE BILL 4249 (Substitute H-1) as passed by the House:

 

The bill would amend Part 201 (environmental response) of the Natural Resources and Environmental Protection Act to define “hazardous substance” as including any substance that the Department of Natural Resources (DNR) demonstrated, on a case-by-case basis, as posing an unacceptable risk to the public health, safety, welfare, or the environment, considering the fate of the material, dose-response, toxicity, or adverse impact on natural resources. This would replace the current provision that includes in the definition a chemical or other material that is or may become injurious to the public health, safety, or welfare or to the environment.

 

(The Act would continue to define “hazardous substance” as also including petroleum, a hazardous substance as defined in the Federal Comprehensive Environmental Response, Compensation, and Liability Act, and hazardous waste as defined in Part 111 (hazardous waste management) of the State Act).
