CONTENT

The bill would amend the Public Health Code to specify that the Code's prohibition against solicitation of a person under 17 years of age by a person 17 years old or older to commit or attempt to commit a controlled substance felony would apply regardless of whether the older person knew that the minor was less than 17 years old.

The bill would take effect on August 1, 1995.

FISCAL IMPACT

There are currently no data available that would indicate whether the knowledge of the minor's age has ever been used as a defense for solicitation of a minor to commit a controlled substance violation. The State could incur additional costs if a person who had previously used the lack of knowledge of the minor's age as a defense, and was therefore not charged, would now be convicted due to the bill's provisions.
