The bill would amend the Library Privacy Act to provide that a library, or employee or agent of the library, could not release or disclose a library record to any person without the written consent of the person liable for payment for, or return of, the materials identified in the record. Currently, under the Act, release of a library record is prohibited unless the person identified in the record gives his or her written consent. (Under the bill, then, if the holder of a library card, such as a minor, differed from the person who was financially responsible for the materials loaned out under the card, the record of the material could be released without the cardholder’s permission, as long as the financially responsible person consented.)
