NONPROFIT VOLUNTEERS: IMMUNITY H.B. 6018: FLOOR ANALYSIS

The bill would amend the Nonprofit Corporation Act to extend to a volunteer director, volunteer officer, or other volunteer liability protections currently afforded to a “nondirector” volunteer.
Public Act 379 of 1996 (House Bill 4824) amended the Nonprofit Corporation Act to allow a corporation to assume liability for all acts or omissions of a “volunteer director, volunteer officer, or other volunteer” rather than for the acts or omissions of a “nondirector volunteer”. Under another section of the Nonprofit Corporation Act, if a corporation’s articles of incorporation include a provision assuming that liability, a claim for monetary damages for a nondirector volunteer’s acts or omissions cannot be brought or maintained against the nondirector volunteer. The bill would delete “nondirector” from that provision and include, instead, a volunteer director, volunteer officer, or other volunteer.
