The bill would amend the Child Protection Law to specify that a person who was required to report suspected child abuse or neglect under the Law and who knew, or from the child’s symptoms suspected that a newborn infant had any amount of alcohol, a controlled substance, or a metabolite of a controlled substance in his or her body would have to report the information to the Family Independence Agency in the same manner as information concerning abuse and neglect is reported. The person would not have to report the information, however, if he or she knew that the alcohol, controlled substance, or metabolite, or the child’s symptoms were the result of medical treatment administered to the newborn infant or his or her mother.
The Law currently requires various individuals, including physicians, dentist, nurses, coroners, psychologists, social workers, school officials, and law enforcement personnel immediately to report suspected child abuse or neglect to the Family Independence Agency. The bill would require the same individuals also to report instances of substance abuse in newborns.
