Senate Joint Resolution V proposes an amendment to the State Constitution of 1963 repealing Section 28 of Article V. That section of the Constitution establishes the State Transportation Commission.
The Transportation Commission establishes policy for the State Transportation Department. It consists of six members, appointed by the Governor with the advice and consent of the Senate, for three-year terms. Not more than three of the members can be from the same political party.
Pursuant to Article XII, Section 1, of the State Constitution, constitutional amendments proposed by the Legislature require a vote of two thirds of the members elected to and serving in each house in order to submit the proposal to the electors.
The Legislature appropriates a per diem payment of $75 per day, not to exceed $10,000 annually for each Commission member. In FY 1994-95 per diem payments totaled $27,714.
The Commission members also are entitled to reasonable and necessary expenses while performing their duties. In FY 1994-95 expenses for the Commission totaled $30,790.
