EXTRADITION COSTS - S.B. 102: FLOOR ANALYSIS

Senate Bill 102 (as reported without amendment)

Sponsor: Senator Joanne G. Emmons

Committee: Judiciary

CONTENT

The bill would amend the Code of Criminal Procedure to allow a court to order an individual who was extradited to Michigan for committing a crime and was convicted of that crime to pay the actual and reasonable costs of the extradition.

Proposed MCL 776.13a - Legislative Analyst: P. Affholter

FISCAL IMPACT

The bill would have no impact on the State, but local units of government could be reimbursed for the cost of extraditions, which is currently paid by the county. The impact would depend on whether the court did order an individual to pay extradition costs if convicted and the ability of the individual to pay those costs. Data are currently not available on the number of extraditions that result in convictions.
