S.B. 112: COMMITTEE SUMMARY - ABOLISH "FIRE FIGHTER'S RULE"
Senate Bill 112 (as introduced 2-4-97)
Sponsor: Senator Michael J. Bouchard
Committee: Judiciary
CONTENT
The bill would amend the Revised Judicature Act to abolish the common law doctrine that precludes a fire fighter or police officer from recovering damages for injuries arising from the normal, inherent, and foreseeable risks of his or her profession.
In addition, the common law doctrine precluding a fire fighter or police officer from recovering damages from a person for injuries arising from an incident caused by the person's negligence would be abolished, unless the person from whom damages were sought was a property owner or tenant whose negligence at his or her owned or rented property did not constitute a violation of law, caused the incident that required the presence of the fire fighter or police officer, and was the basis for the action for damages.

FISCAL IMPACT
The fiscal impact of the bill is indeterminate. There could be a potential for a governmental entity to be sued for damages depending on the number of police or fire fighters who were hurt on the job and decided to seek damages.
