S.B. 718: COMMITTEE SUMMARY - BAR CLAIM FOR INJURY OR DEATH

CONTENT
The bill would amend the Revised Judicature Act to provide that, if an individual were injured or killed while committing a violation of a Federal, State, or local penal statute, regulation, or ordinance, for which he or she was convicted, the individual or his or her estate would be barred from bringing an action for damages, based on the injury or death, against any of the following:
-- The victim of the crime or the victim's estate.
-- A law enforcement officer, prosecuting attorney, or other government employee involved in the arrest or prosecution of the individual, or the estate of the officer, prosecuting attorney, or government employee.
-- Any other person involved in attempting to stop the crime or assist the victim, or the estate of such a person.

FISCAL IMPACT
The bill would have an indeterminate impact on the State and local units of government to the extent that it could bar future actions for damages against the State and local units of government.
