CON: OPERATING ROOMS - S.B. 1231: FLOOR ANALYSIS

Senate Bill 1231 (as reported without amendment)

Sponsor: Senator John J.H. Schwarz, M.D.

Committee: Health Policy and Senior Citizens

CONTENT

The bill would amend the Public Health Code to provide that if a hospital provided both emergency room services and obstetrical services, and were replacing not more than two operating rooms at the same time, then certain certificate of need (CON) standards would not apply. (The particular standards are contained in Section 6 of the "CON Review Standards For Surgical Services", approved by the CON Commission December 12, 1995.)

Section 6, as approved by the CON Commission, requires an applicant proposing to replace an existing surgical service or one or more operating rooms at the same site to demonstrate that all existing and proposed operating rooms have been or will be used for at least a specified number of hours or surgical cases.

Proposed MCL 333.22209a - Legislative Analyst: G. Towne
