H.B. 4044 (H-1): COMMITTEE SUMMARY - ABOLISH "FIREFIGHTER'S RULE"
House Bill 4044 (Substitute H-1 as passed by the House)
Sponsor: Representative Kirk Profit
House Committee: Judiciary
Senate Committee: Judiciary
CONTENT
The bill would amend the Revised Judicature Act to abolish the common law doctrine that precludes a firefighter or police officer from recovering damages for injuries arising from the normal, inherent, and foreseeable risks of his or her profession.
A firefighter or police officer would have no claim, however, against a governmental agency, its agents, or its employees, for injury or death occasioned by the negligence of the agency, its agents, or its employees if the event that caused his or her presence at the premises were within the scope of his or her professional activities, duties, or functions. The bill would not in any way alter a governmental agency's immunity for the performance of governmental functions or liability under any other provision of law.
Proposed MCL 600.2964 & 600.2965 - Legislative Analyst: P. Affholter
FISCAL IMPACT
The bill would have no fiscal impact on State or local government.
