A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1809 (MCL 380.1809), as added by 1995 PA 96. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1809. (1) In addition to any other penalty provided by 2 law, a person who uses or attempts to use a teaching certificate 3 that he or she knows is surrendered, suspended, revoked, nulli- 4 fied, fraudulently obtained, altered, or forged, or who uses or 5 attempts to use as his or her own a valid teaching certificate 6 that he or she knows is issued to another person, to obtain 7 employment in a position requiring a valid teaching certificate 8 or who remains employed in a position requiring a valid teaching 9 certificate knowing that he or she does not hold a valid teaching 10 certificate is guilty of a misdemeanor, punishable as follows: 00205'97 TAV 2 1 (a) For the first offense, by imprisonment for not more than 2 93 days or a fine of not more than $500.00, or both. 3 (b) For a second or subsequent offense, by imprisonment for 4 not less than 93 days or more than 6 months, or a fine of not 5 less than $500.00 or more than $1,000.00, or both. 6 (2) In addition to any other penalty provided by law, a 7 person who uses or attempts to use a school administrator's cer- 8 tificate that he or she knows is surrendered, suspended, revoked, 9 nullified, fraudulently obtained, altered, or forged, or who uses 10 or attempts to use as his or her own a valid school 11 administrator's certificate that he or she knows is issued to 12 another person, to obtain employment as a school administrator or 13 who remains employed in a position requiring a valid school 14 administrator's certificate knowing that he or she does not hold 15 a valid school administrator's certificate is guilty of a misde- 16 meanor, punishable as follows: 17 (a) For the first offense, by imprisonment for not more than 18 93 days or a fine of not more than $500.00, or both. 19 (b) For a second or subsequent offense, by imprisonment for 20 not less than 93 days or more than 6 months, or a fine of not 21 less than $500.00 or more than $1,000.00, or both. 22 (3) In addition to any other penalty provided by law, a 23 person who uses or attempts to use a state board approval that he 24 or she knows is surrendered, suspended, revoked, nullified, 25 fraudulently obtained, altered, or forged, or who uses or 26 attempts to use as his or her own a valid state board approval 27 that he or she knows is issued to another person, to obtain 00205'97 3 1 employment in a position requiring a valid state board approval 2 or who remains employed in a position requiring a valid state 3 board approval knowing that he or she does not hold a valid state 4 board approval is guilty of a misdemeanor, punishable as 5 follows: 6 (a) For the first offense, by imprisonment for not more than 7 93 days or a fine of not more than $500.00, or both. 8 (b) For a second or subsequent offense, by imprisonment for 9 not less than 93 days or more than 6 months, or a fine of not 10 less than $500.00 or more than $1,000.00, or both. 11 (4) In addition to any other penalty provided by law, a 12 person who uses or attempts to use a college or university tran- 13 script or a certificate or othercredentialDOCUMENT that he or 14 she knows is fraudulently obtained, altered, or forged, or who 15 uses or attempts to use as his or her own a college or university 16 transcript or a certificate or othercredentialDOCUMENT that 17 he or she knows is that of another person, to obtain a teaching 18 certificate, school administrator's certificate, or state board 19 approval in this state is guilty of a misdemeanor, punishable as 20 follows: 21 (a) For the first offense, by imprisonment for not more than 22 93 days or a fine of not more than $500.00, or both. 23 (b) For a second or subsequent offense, by imprisonment for 24 not less than 93 days or more than 6 months, or a fine of not 25 less than $500.00 or more than $1,000.00, or both. 26 (5) The state board may refuse to issue or renew a teaching 27 certificate, school administrator's certificate, or state board 00205'97 4 1 approval, or refuse to issue an endorsement for a teaching 2 certificate or school administrator's certificate, to a person 3 convicted of a violation of this section. 4 (6) As used in this section, "state board approval" means 5 that term as defined in section 1539b. 00205'97 Final page.
