A bill to amend 1943 PA 184, entitled "The township rural zoning act," by amending section 1 (MCL 125.271), as amended by 1996 PA 47. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. (1) The township board of an organized A township 2 in this state may provide by zoning ordinance for the regula- 3 tion of land development and the establishment of districts in 4 the portions of the township outside the limits of cities and 5 villages which THAT regulate the use of land and structures ; 6 to meet the needs of the state's citizens for food, fiber, 7 energy, and other natural resources, places of residence, recre- 8 ation, industry, trade, AND service, and other uses of land; to 9 insure that use ENSURE THAT USES of the land shall be situated 10 in appropriate locations and relationships; to limit the 11 inappropriate overcrowding of land and congestion of population 00411'97 TMV 2 1 , AND OF transportation systems , and other public 2 facilities; to facilitate adequate and efficient provision for 3 transportation systems, sewage disposal, water, energy, educa- 4 tion, recreation, and other public service and facility require- 5 ments; and to promote public health, safety, and welfare. For 6 these purposes, the township board may divide the township into 7 districts of such A number, shape, and area as THAT it con- 8 siders best suited to carry out this act. The township board of 9 an organized A township may use this act to provide by ordi- 10 nance for the regulation of land development and the establish- 11 ment of districts which THAT apply only to land areas and 12 activities which THAT are involved in a special program to 13 achieve specific land management objectives and avert or solve 14 specific land use problems, including the regulation of land 15 development and the establishment of districts in areas subject 16 to damage from flooding or beach erosion, and for that purpose 17 may divide the township into districts of a number, shape, and 18 area considered best suited to accomplish those objectives. 19 Ordinances regulating land development may also be adopted desig- 20 nating or limiting the location, the height, number of stories, 21 and size of dwellings, buildings, and structures that may be 22 erected or altered, including tents and trailer coaches, and the 23 specific uses for which SIZE, AND SPECIFIC USES OF dwellings, 24 buildings, and structures, including tents and trailer coaches, 25 THAT may be erected or altered; the area of yards, courts, and 26 other open spaces, and the sanitary, safety, and protective 27 measures that shall be required for the dwellings, buildings, and 00411'97 3 1 structures; , including tents and trailer coaches; and the 2 maximum number of families which THAT may be housed in 3 buildings, THE dwellings, BUILDINGS, and structures. , 4 including tents and trailer coaches, erected or altered. The 5 provisions shall be uniform for each class of land or 6 buildings, dwellings, BUILDINGS, and structures , including 7 tents and trailer coaches, throughout each district, but the 8 provisions in 1 district may differ from those in other 9 districts. A township board shall not regulate or control the 10 drilling, completion, or operation of oil or gas wells, or other 11 wells drilled for oil or gas exploration purposes and shall not 12 have jurisdiction with reference to the issuance of permits for 13 the location, drilling, completion, operation, or abandonment of 14 those wells. The jurisdiction relative to wells shall be vested 15 exclusively in the supervisor of wells of this state, as provided 16 in part 615 (supervisor of wells) of the natural resources and 17 environmental protection act, Act No. 451 of the Public Acts of 18 1994, being sections 324.61501 to 324.61527 of the Michigan 19 Compiled Laws. 20 (2) An ordinance adopted pursuant to this act is subject to 21 the electric transmission line certification act 1995 PA 30, MCL 22 460.561 TO 460.575. 00411'97 Final page.
