A bill to amend 1953 PA 232, entitled "An act to revise, consolidate, and codify the laws relating to probationers and probation officers, to pardons, reprieves, com- mutations, and paroles, to the administration of correctional institutions, correctional farms, and probation recovery camps, to prisoner labor and correctional industries, and to the super- vision and inspection of local jails and houses of correction; to provide for the siting of correctional facilities; to create a state department of corrections, and to prescribe its powers and duties; to provide for the transfer to and vesting in said department of powers and duties vested by law in certain other state boards, commissions, and officers, and to abolish certain boards, commissions, and offices the powers and duties of which are transferred by this act; to prescribe the powers and duties of certain other state departments and agencies; to provide for the creation of a local lockup advisory board; to prescribe pen- alties for the violation of the provisions of this act; to make certain appropriations; to repeal certain parts of this act on specific dates; and to repeal all acts and parts of acts incon- sistent with the provisions of this act," by amending section 63a (MCL 791.263a). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 63a. (1) A person employed by IN a penal 2 institution STATE CORRECTIONAL FACILITY in this state who is 00013'97 DRM 2 1 injured as a result of an assault by an inmate of a penal 2 institution A PRISONER OR BY A PERSON VISITING A PRISONER, or 3 WHO IS injured during a riot, shall receive his OR HER full wages 4 by the department of corrections until workmen's WORKER'S com- 5 pensation benefits begin and then shall receive in addition to 6 workmen's WORKER'S compensation benefits a supplement from the 7 department which THAT together with the workmen's WORKER'S 8 compensation benefits shall equal but not exceed the weekly net 9 wage of the employee at the time of the injury. This supplement 10 shall only apply while the person is on the department's payroll 11 and is receiving workmen's WORKER'S compensation benefits. and 12 shall include an employee who is currently receiving workmen's 13 compensation due to an injury covered by this section. Fringe 14 benefits normally received by an employee shall be in effect 15 during the time the employee receives the supplement provided by 16 this section from the department. 17 (2) For purposes of AS USED IN this section, "penal 18 institution" includes the state prison of southern Michigan in 19 the township of Blackman, the county of Jackson; the state house 20 of correction and branch of state prison at Marquette, in the 21 county of Marquette; the Michigan reformatory at Ionia, in the 22 county of Ionia; the Muskegon correctional facility, the Michigan 23 training unit at Ionia and any other state prison, state reforma- 24 tory, state farm probation recovery camp or other state probation 25 facility for adults hereafter established. "STATE CORRECTIONAL 26 FACILITY" MEANS A FACILITY OPERATED BY THE DEPARTMENT OF 27 CORRECTIONS, OR OPERATED BY ANOTHER PARTY UNDER CONTRACT WITH THE 00013'97 3 1 DEPARTMENT OF CORRECTIONS, THAT HOUSES PRISONERS SERVING A 2 SENTENCE OF IMPRISONMENT UNDER THE JURISDICTION OF THE 3 DEPARTMENT. 00013'97 Final page.
