HOUSE BILL No. 4324 February 13, 1997, Introduced by Reps. Harder, Bogardus, Hanley, Hale, Green, DeHart, Baade, Cropsey, Leland, Brewer, Curtis, Cherry, Willard, Gire, Olshove and Wetters and referred to the Committee on Public Retirement. A bill to amend 1978 PA 325, entitled "An act to provide for a suggestion awards program; and to pre- scribe the duties of the department of civil service," by amending sections 1, 2, 3, and 4 (MCL 38.1161, 38.1162, 38.1163, and 38.1164). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Board" means the suggestion awards board. 3 (b) "Department" means the department of civil service. 4 (c) "Director" means the director of the department. 5 (D) "RETIRED STATE EMPLOYEE" MEANS AN INDIVIDUAL WHO WAS A 6 STATE EMPLOYEE AND IS RECEIVING A RETIREMENT BENEFIT FROM THIS 7 STATE. 8 (E)(d)"State employee" means a classified or 9 unclassified member of the state civil service or an unclassified 00843'97 JLB 2 1 employee of the executive, legislative, or judicial branch of 2 state government. 3 Sec. 2. (1) The department may establish a suggestion 4 awards board within the department to consist of 5 members 5 appointed by the director. If established, the director shall 6 select the members from a list of state employees. Not more than 7 1 nominee shall be from the same state department. 8 (2) The terms of the members, except to fill vacancies 9 occurring other than by expiration of term, shall be 2 years from 10 the date of appointment. A vacancy in the office of a member, 11 occurring other than by expiration of term, shall be filled by 12 the director, or his OR HER designee, for the balance of the 13 term. Not more than 1 member shall be from the same state 14 department. The members shall elect a chairperson of the board. 15 (3) The board shall DO ALL OF THE FOLLOWING: 16 (a) Develop a plan for evaluating suggestions made by state 17 employees OR RETIRED STATE EMPLOYEES, including the establishment 18 of guidelines for the type of award to be made within the limits 19 of section 5. 20 (b)BePERFORM the finalreviewerREVIEW of an award 21whichTHAT is greater than$100.00$500.00 and of any sugges- 22 tionwhich includes a grievanceTHAT IS APPEALED. 23 (c) Prepare the rules for promulgation by the department 24 under section 6 for the operation of the plan under subdivision 25 (a). 00843'97 3 1 Sec. 3. (1) If a board is established under section 2, the 2 director shall appoint a suggestion administrator from the 3 employees of the department. 4 (2) The suggestion administrator shall be responsible FOR 5 ALL OF THE FOLLOWING: 6 (a)For theTHE administrative supervision and promotion 7 of the suggestion awards program. 8 (b)For theTHE final review of an awardwhichTHAT is 9 not greater than$100.00$500.00 OR ITS EQUIVALENT. 10 (c)For theTHE submission of quarterly reports to the 11 appropriation committees in the house of representatives and the 12 senate, to the house and senate fiscal agencies, and to the 13 department of management and budget regarding the number and 14 nature of suggestions submitted and adopted, including the esti- 15 mated savings involved with each suggestion adopted.The report16on an adopted suggestion having an estimated savings of17$10,000.00 or more shall set forth the department, division, and18bureau affected; the situation which gave rise to the suggestion;19the proposed change; and analysis of the suggestion by the20affected department; the basis used in determining the savings;21and any other information which may be beneficial to the report.22 (d)For theTHE submission to the board OF a suggestion 23for whichTHAT is recommended FOR an award of more than 24$100.00$500.00 or its equivalent. 25 (3) THE REPORT REQUIRED UNDER SUBSECTION (2)(C) SHALL SET 26 FORTH ALL THE FOLLOWING ON AN ADOPTED SUGGESTION THAT HAS AN 27 ESTIMATED SAVINGS OF $10,000.00 OR MORE: 00843'97 4 1 (A) THE DEPARTMENT, DIVISION, AND BUREAU AFFECTED. 2 (B) THE SITUATION THAT GAVE RISE TO THE SUGGESTION. 3 (C) THE PROPOSED CHANGE AND ANALYSIS OF THE SUGGESTION BY 4 THE AFFECTED DEPARTMENT. 5 (D) THE BASIS USED IN DETERMINING THE SAVINGS. 6 (E) ANY OTHER INFORMATION THAT MAY BE CONSIDERED BENEFICIAL 7 TO THE REPORT. 8 Sec. 4. (1) If a board is established under section 2, the 9 head of each state department shall establish a committeeto10consist of 3WITH AN UNEVEN NUMBER OF members who are employees 11 of the state department and whoshall beARE appointed by the 12 head of the state department. THE COMMITTEE SHALL HAVE NO LESS 13 THAN 3 MEMBERS AND NOT MORE THAN 11 MEMBERS BASED ON NEED AS 14 DETERMINED BY THE HEAD OF THE STATE DEPARTMENT. The committee 15 shall review the suggestionswhichTHAT pertain to the opera- 16 tions of that state department. 17 (2) The committee, without undue delay, shall report to the 18 suggestion administrator concerning each suggestion submitted. 19 The report shall containanALL OF THE FOLLOWING: 20 (A) AN analysis of the suggestion.; the21 (B) THE reasons for approval or disapproval.; if22 (C) IF approved, the estimated savings; if approved, a23 AND recommended award.; and any24 (D) ANY other necessary informationwhichTHAT may be 25 required by this act or a rule promulgated under this act. 00843'97 Final page.
