A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1284 (MCL 380.1284), as amended by 1995 PA 289. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1284. (1) The board of a school district or of a 2 public school academy shall determine the length of the school 3 term. However, except as otherwise provided in subsections (2) 4 and (3), if the board does not want the school district's or 5 public school academy's state school aid payments to be withheld 6 as described in section 101 of the state school aid act of 1979, 7 being section 388.1701 of the Michigan Compiled Laws MCL 8 388.1701, the board shall ensure that the minimum number of days 9 of pupil instruction in a school year is 180 through the 10 1996-1997 school year and is 181 in the 1997-1998 school year, 02214'97 TAV 2 1 182 in the 1998-1999 school year, 183 in the 1999-2000 school 2 year, 184 in the 2000-2001 school year, 185 in the 2001-2002 3 school year, 186 in the 2002-2003 school year, 187 in the 4 2003-2004 school year, 188 in the 2004-2005 school year, 189 in 5 the 2005-2006 school year, and 190 in the 2006-2007 school year 6 and each succeeding school year, and shall ensure that the mini- 7 mum number of hours of pupil instruction in a school year is 900 8 for the 1994-95 school year, 990 for the 1995-96 and 1996-97 9 school years, 1,041 for the 1997-1998 school year, 1,047 for the 10 1998-1999 school year, 1,098 for the 1999-2000 school year, 1,104 11 for the 2000-2001 school year, 1,110 for the 2001-2002 school 12 year, 1,116 for the 2002-2003 school year, 1,122 for the 13 2003-2004 school year, 1,128 for the 2004-2005 school year, 1,134 14 for the 2005-2006 school year, and 1,140 for the 2006-2007 school 15 year and each succeeding school year. 16 (2) If the DEPARTMENT DETERMINES THAT THE percentage growth 17 in the basic foundation allowance under section 20 of the state 18 school aid act of 1979, being section 388.1620 of the Michigan 19 Compiled Laws MCL 388.1620, for a state fiscal year, as compared 20 to the basic foundation allowance for the immediately preceding 21 state fiscal year, is less than the percentage increase in the 22 average consumer price index for all items, as determined by the 23 United States bureau of labor statistics, for the 12-month 24 period ending on the June 30 immediately preceding the beginning 25 of the state fiscal year CALENDAR YEAR IMMEDIATELY PRECEDING THE 26 CALENDAR YEAR IN WHICH THE STATE FISCAL YEAR BEGINS AS COMPARED 27 TO THE SECOND PRECEDING CALENDAR YEAR BEFORE THE CALENDAR YEAR IN 02214'97 3 1 WHICH THE STATE FISCAL YEAR BEGINS, then there shall be no 2 increase in the required minimum number of days or hours of pupil 3 instruction under subsection (1) for the school year ending in 4 the state fiscal year. For the next school year after a school 5 year for which there is no increase in the required minimum 6 number of days and hours of pupil instruction under 7 subsection (1) because of the operation of this subsection, and 8 if the first sentence of this subsection does not apply, the 9 increase in the required minimum number of days and hours of 10 pupil instruction shall only be 1 day and the corresponding 11 number of hours. This subsection shall apply and shall operate 12 to limit increases under subsection (1) until the required mini- 13 mum number of days and hours of pupil instruction under this sec- 14 tion is 190 days and 1,140 hours. 15 (3) The board of a school district or public school academy, 16 by resolution, may choose to provide less than the number of days 17 of pupil instruction required under subsection (1), but shall 18 provide at least 180 days of pupil instruction and at least the 19 number of hours of pupil instruction required under subsection 20 (1). 21 (4) Not later than August 1, the board of each school dis- 22 trict and of each public school academy shall certify to the 23 state board the number of days and hours of pupil instruction in 24 the previous school year. 25 (5) Days lost because of strikes or teachers' conferences 26 shall not be counted as days of pupil instruction. 02214'97 4 1 (6) The state board shall promulgate rules for the 2 implementation of this section. 02214'97 Final page.
