        A bill to amend 1943 PA 240, entitled

   "State employees' retirement act,"

   by amending section 24 (MCL 38.24).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 24.  Subject to  the provisions of  sections 33 and 34,

 2    upon application of a member,  or his  THE MEMBER'S department

 3    head, or the state personnel director, a member who has been a

 4    state employee  at least  WITH 10 OR MORE years OF CREDITED STATE

 5    SERVICE, OR A MEMBER WHO MEETS THE SERVICE REQUIREMENTS FOR A

 6    DEFERRED RETIREMENT ALLOWANCE UNDER SECTION 20(4) OR (5) AND WHO

 7    becomes totally and permanently incapacitated for duty as the

 8    result of causes occurring not in the performance of duty to

 9     the  THIS state, may be retired by the retirement board AS

10    PROVIDED IN THIS SECTION.  :  Provided, The  IF THE medical

11    advisor after a medical examination of  such  THE member

 1    DETERMINES THAT THE MEMBER HAS BECOME TOTALLY AND PERMANENTLY

 2    INCAPACITATED FOR DUTY, THE MEDICAL ADVISOR shall certify that

 3     such  THE member is mentally or physically incapacitated for the

 4    further performance of duty,  and such  THAT THE incapacity is

 5    likely to be permanent, and that  such  THE member should be

 6    retired.
