HOUSE BILL No. 4582


     April 8, 1997, Introduced by Reps. Gire, Law, Freeman, DeHart, Brown, Crissman and Cropsey and referred to the Committee on Regulatory Affairs.


        A bill to prescribe the powers and duties of certain state

   and local officials relating to the regulation of certain prizes

   and sweepstakes.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1.  (1) The attorney general or a county prosecutor

 2    shall investigate violations of the prize and sweepstakes regula-

 3    tion act, and on behalf of this state may bring an action in the

 4    circuit court for 1 or more of the following:

 5         (a) Temporary or permanent injunctive or other relief for a

 6    violation of the prize and sweepstakes regulation act.

 7         (b) The sanctions authorized under section 8 of the prize

 8    and sweepstakes regulation act.

 9         (c) Rescission of a contract for goods or services offered

10    in conjunction with a prize promotion that violates the prize and

11    sweepstakes regulation act.

 1         (2) Upon entry of final judgment in an action authorized

 2    under subsection (1), the court may award restitution to a person

 3    who suffered loss arising from a prize promotion that violates

 4    the prize and sweepstakes regulation act if proof of the loss is

 5    submitted to the satisfaction of the court.

 6         Enacting section 1.  This act does not take effect unless

 7    Senate Bill No. _____ or House Bill No. _____ (request

 8    no. 00159'97 *) of the 89th Legislature is enacted into law.
