A bill to amend 1978 PA 368, entitled "Public health code," by amending section 16401 (MCL 333.16401). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 16401. (1) As used in this part: 2 (a) "Chiropractor", "chiropractic physician", "doctor of 3 chiropractic", or "d.c." means an individual licensed under this 4 article to engage in the practice of chiropractic. 5 (b) "Practice of chiropractic" means that discipline within 6 the healing artswhichTHAT deals with the nervous system and 7 its relationship to the spinal column anditsWITH THEIR inter- 8 relationship with other body systems. Practice OF CHIROPRACTIC 9 DOES NOT INCLUDE THE PERFORMANCE OF INCISIVE SURGICAL PROCEDURES, 10 THE PERFORMANCE OF AN INVASIVE SURGICAL PROCEDURE REQUIRING 11 INSTRUMENTATION, OR THE DISPENSING OR PRESCRIBING OF DRUGS OR 01952'97 CPD 2 1 MEDICINE. SUBJECT TO SECTION 16423, PRACTICE of chiropractic 2 includes: 3 (i) Diagnosis, including spinal analysis AND EXAMINATION, to 4 determine the existence of spinal subluxations or misalignments 5 that produce nerve interference OR OTHER HUMAN AILMENTS, indicat- 6 ing the necessity for chiropractic care. 7 (ii) The adjustment of spinal subluxations or misalignments 8 and related bones and tissues for the establishment of neural 9 integrity utilizing the inherent recuperative powers of the body 10 for restoration and maintenance of health. 11 (iii) The use of analytical instruments, nutritional advice, 12 rehabilitative exercise,andadjustment apparatus WITH OR WITH- 13 OUT ASSISTIVE DEVICES regulated by rules promulgated by the board 14pursuant toUNDER section 16423, and the use of x-ray machines 15 in the examination of patients for the purpose of locating spinal 16 subluxations or misaligned vertebrae of the human spine.The17practice of chiropractic does not include the performance of18incisive surgical procedures, the performance of an invasive pro-19cedure requiring instrumentation, or the dispensing or prescrib-20ing of drugs or medicine.21 (2) In addition to the definitions in this part, article 1 22 contains general definitions and principles of construction 23 applicable to all articles in this code and part 161 contains 24 definitions applicable to this part. 01952'97 Final page.
