        A bill to amend 1978 PA 642, entitled

   "Revised probate code,"

   by amending section 103 (MCL 700.103).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec.  103.  A hospital, convalescent or nursing home,

 2    morgue, or law enforcement agency holding cash not exceeding

 3     $100.00  $500.00 and wearing apparel of a decedent may deliver

 4    the cash and wearing apparel to a person furnishing identifica-

 5    tion and an affidavit that the person is the spouse, child, or

 6    parent of the decedent and that an estate of the decedent is not

 7    pending.  The hospital, home, morgue, or law enforcement agency

 8    making the delivery shall be released to the same extent as if

 9    delivery were made to a legally qualified fiduciary of the

10    decedent's estate and is not required to see to the disposition

11    of the property.  The person to whom delivery is made  shall be

 1    IS answerable  therefor  FOR THE PROPERTY to a person having a

 2    prior right and IS accountable to a fiduciary of the estate of

 3    the decedent  thereafter  appointed AFTER THE DELIVERY.
