A bill to amend 1905 PA 157, entitled "An act to provide for the acquisition, maintenance, management, and control of township parks, resorts, bathing beaches, and places of recreation; to provide for the creation of a township park commission; to provide for a board of commissioners to pro- vide for the issuance of bonds and the levy of taxes; to provide for the transfer of certain real property for parks; to authorize cities and villages to appropriate money for park purposes; to provide for the acquisition, construction, and use of wharves, piers, docks, and landing places in townships; and to provide the powers and duties of certain local units of government and cer- tain officials," by amending sections 6c and 6d (MCL 41.426c and 41.426d), as added by 1989 PA 79. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 6c. (1) The township park commission shall submit to 2 the township board a detailed budget covering the cost of mainte- 3 nance of the township parks and places of recreation of the 4 township for the ensuing year. AFTER 1996, THE BUDGET SHALL NOT EXCEED 1.5 2 MILL ON THE TAXABLE VALUE OF THE TOWNSHIP. The township board 3 shall examine the budget and shall approve the entire budget, or 4 a part of the budget that the board considers reasonable and nec- 5 essary, which sum shall be incorporated into the tax on the 6 township, and when collected shall be deposited by the township 7 treasurer in a fund to be known as the park maintenance fund. 8 Expenditures from this THE PARK MAINTENANCE fund shall be on 9 vouchers approved by the township park commission, and it shall 10 be the duty of the township treasurer to SHALL allow and pay 11 these vouchers on presentation to him or her. The assessment, 12 levy, and collection of the tax provided in this section shall be 13 performed in the manner provided in the general property tax act, 14 Act No. 206 of the Public Acts of 1893, being sections 211.1 to 15 211.157 of the Michigan Compiled Laws 1893 PA 206, MCL 211.1 TO 16 211.157. 17 (2) AS USED IN THIS SECTION AND SECTION 6D, "TAXABLE VALUE" 18 MEANS THAT VALUE DETERMINED UNDER SECTION 27A OF THE GENERAL 19 PROPERTY TAX ACT, 1893 PA 206, MCL 211.27A. 20 Sec. 6d. The township park commission may request that the 21 township board submit to the voters of the township the question 22 of the issuance of township bonds, the proceeds of which shall be 23 used in the acquisition of lands for township parks and places of 24 recreation. A majority vote of the qualified voters voting shall 25 authorize the issuance of township bonds. The issuance of town- 26 ship bonds shall be governed by the municipal finance act, Act 27 No. 202 of the Public Acts of 1943, being sections 131.1 to 139.3 02973'97 h 3 1 of the Michigan Compiled Laws. However 1943 PA 202, MCL 131.1 2 TO 139.3. BEFORE 1997, if the township has no outstanding 3 indebtedness, bonded or otherwise, and the amount of the total 4 proposed acquisition cost is less than 1 per cent 1% of the 5 assessed valuation of the township, the township board may autho- 6 rize and direct the township park commission to purchase or con- 7 demn designated lands for township parks and places of recreation 8 and may pay annually to the township park commission the avail- 9 able portions of contingent funds of the township necessary to 10 pay for the acquisition of the lands. AFTER 1996, IF THE TOWN- 11 SHIP HAS NO OUTSTANDING INDEBTEDNESS, BONDED OR OTHERWISE, AND 12 THE AMOUNT OF THE TOTAL PROPOSED ACQUISITION COST IS LESS THAN 1% 13 OF THE TAXABLE VALUE OF THE TOWNSHIP, THE TOWNSHIP BOARD MAY 14 AUTHORIZE AND DIRECT THE TOWNSHIP PARK COMMISSION TO PURCHASE OR 15 CONDEMN DESIGNATED LANDS FOR TOWNSHIP PARKS AND PLACES OF RECRE- 16 ATION AND MAY PAY ANNUALLY TO THE TOWNSHIP PARK COMMISSION THE 17 AVAILABLE PORTIONS OF CONTINGENT FUNDS OF THE TOWNSHIP NECESSARY 18 TO PAY FOR THE ACQUISITION OF THE LANDS. The township board shall 19 determine the maximum amount to be paid for these lands and, if 20 acquisition is made by purchase instead of condemnation, shall 21 also prescribe the terms of payment. 02973'97 h Final page.
