A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 207 (MCL 257.207), as amended by 1996 PA 102. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 207. (1) An officer or employee designated by the sec- 2 retary of state for the purpose of administering the motor vehi- 3 cle laws shall administer oaths and acknowledge signatures with- 4 out CHARGING A fee. 5 (2) The UPON REQUEST, THE secretary of state and the 6 officers designated by the secretary of state may prepare under 7 the seal of the secretary of state and deliver upon request, a 8 certified copy of a record maintained under this act. and THE 9 SECRETARY OF STATE MAY charge a fee as set forth PROVIDED in 10 this act OR AS OTHERWISE PROVIDED BY LAW FOR A COPY OF THE 02261'97 TJS 2 1 RECORD. THE SECRETARY OF STATE SHALL NOT CHARGE A FEE TO AN 2 ORGANIZATION EXEMPT FROM TAXATION UNDER SECTION 501(c)(3) OF THE 3 INTERNAL REVENUE CODE IF THE ORGANIZATION ONLY REQUESTS A RECORD 4 CHECK BUT DOES NOT REQUEST AN ACTUAL COPY OF THE RECORD. AN 5 ORGANIZATION EXEMPT FROM TAXATION UNDER SECTION 501(c)(3) OF THE 6 INTERNAL REVENUE CODE THAT RECEIVES AN ACTUAL COPY OF A RECORD 7 SHALL PAY THE SAME FEE AS ANY OTHER REQUESTOR OF A RECORD COPY. 8 (3) A certified computer-generated or paper copy of a record 9 maintained under this act PREPARED BY THE SECRETARY OF STATE 10 shall be admissible in a proceeding in a court in the same manner 11 as the original record and shall be prima facie evidence of the 12 contents of and the facts stated on the record. 13 (4) An order, record, or paper generated by the computerized 14 central file of the secretary of state may be certified electron- 15 ically by the generating computer. The certification shall be a 16 certification of the order, record, or paper as it appeared on a 17 specific date. 18 (5) A court or the office of the clerk of a court of this 19 state that is electronically connected by a terminal device to 20 the computerized central file of the secretary of state may 21 receive into and use as evidence in any case the 22 computer-generated certified information obtained by the terminal 23 device from the file. A duly authorized employee of a court of 24 record of this state may order a record for an individual from a 25 secretary of state computer terminal device located in, and under 26 the control of, the court, and certify in writing that the 02261'97 3 1 document was produced from the terminal and that the document was 2 not altered in any way. 02261'97 Final page.
