     May 15, 1997, Introduced by Reps. Llewellyn, Rhead, Varga, Cropsey, McBryde, Bodem, Goschka, London, Lowe, Walberg, Gernaat, Hammerstrom, Oxender, McManus, Horton, Green, Anthony, Tesanovich, McNutt and Harder and referred to the Committee on Conservation, Environment and Recreation.


        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   (MCL 324.101 to 324.90106) by amending the title, as amended by

   1996 PA 434, and by adding part 400.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to protect the environment and natural resources of

 3    the state; to codify, revise, consolidate, and classify laws

 4    relating to the environment and natural resources of the state;

 5    to regulate the discharge of certain substances into the environ-

 6    ment; TO DECLARE THE RIGHT TO CERTAIN USES OF RENEWABLE

 7    RESOURCES; to regulate the use of certain lands, waters, and

 8    other natural resources of the state; to prescribe the powers and

 9    duties of certain state and local agencies and officials; to

10    provide for certain charges, fees, and assessments; to provide

 1    certain appropriations; to prescribe penalties and provide

 2    remedies; to repeal certain parts of this act on a specific date;

 3    and to repeal  certain  acts and parts of acts.

 4           PART 400.  RIGHT TO HARVEST, HUNT, FISH, AND GATHER.

 5         SEC. 4001.  THE PEOPLE OF MICHIGAN HAVE THE RIGHT TO HAR-

 6    VEST, HUNT, FISH, AND GATHER FROM THEIR RENEWABLE RESOURCES.

 7    THESE RESOURCES INCLUDE GAME BIRDS AND ANIMALS, FISH STOCKS, FUR-

 8    BEARERS, AND PLANTS WHICH ARE THE PROPERTY OF THE PEOPLE AND ARE

 9    HELD AND MANAGED IN THE PUBLIC TRUST TO ENSURE OPTIMUM PARTICIPA-

10    TION AND ACCESS FOR ALL CITIZENS.

11         Enacting section 1.  This amendatory act does not take

12    effect unless Senate Joint Resolution _____ or House Joint

13    Resolution _____ (request no. 02693'97) of the 89th Legislature

14    becomes a part of the state constitution of 1963 as provided in

15    section 1 of article XII of the state constitution of 1963.
