A bill to amend 1933 (Ex Sess) PA 8, entitled "The Michigan liquor control act," by amending section 18 (MCL 436.18), as amended by 1994 PA 185. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 18. (1) A person who holds or whose spouse holds, 2 either by appointment or election, a public office which involves 3 the duty to enforce any of the penal laws of the United States, 4 or the penal laws of this state, or a penal ordinance or resolu- 5 tion of any municipal subdivision of the state, except civil 6 defense volunteer police, TOWNSHIP ATTORNEYS, mayors or council 7 members of cities,orvillage presidents,ormayors of home 8 rule cities whose law enforcement authority under the city 9 charter is restricted to emergency situations, or the state 10 treasurer of this state when acting in the capacity of custodian 11 of the assets of the state retirement systems created by the 03332'97 LBO 2 1 public school employees retirement act of 1979,Act No. 300 of2the Public Acts of 1980, being sections 38.1301 to 38.1408 of the3Michigan Compiled Laws1980 PA 300, MCL 38.1301 TO 38.1437; the 4 state employees' retirement act,Act No. 240 of the Public Acts5of 1943, being sections 38.1 to 38.48 of the Michigan Compiled6Laws1943 PA 240, MCL 38.1 TO 38.69; the state police retirement 7 act of 1986,Act No. 182 of the Public Acts of 1986, being sec-8tions 38.1601 to 38.1648 of the Michigan Compiled Laws1986 PA 9 182, MCL 38.1601 TO 38.1648; and the judges retirement act of 10 1992,Act No. 234 of the Public Acts of 1992, being sections1138.2101 to 38.2608 of the Michigan Compiled Laws1992 PA 234, 12 MCL 38.2101 TO 38.2670, and members of these state retirement 13 systems only if the state treasurer makes an investment in the 14 name of the respective retirement system to which such members 15 belong, shall not be issued a license, or have an interest, 16 directly or indirectly, in a license. However, a nonprofit fra- 17 ternal organization incorporated under the laws of this state, 18 whose membership is not totally composed of law enforcement per- 19 sonnel or public officeholders charged with the duty of enforcing 20 any penal laws or ordinances of a governmental body, may be 21 issued a club liquor license if the organization is otherwise 22 qualified. 23 (2) As used in this section, "law enforcement personnel" 24 does not include the mayor of a city, A TOWNSHIP ATTORNEY, or the 25 state treasurer of this state when acting in the capacity of cus- 26 todian of the assets of the state retirement systems created by 27Act No. 300 of the Public Acts of 1980, Act No. 240 of the03332'97 3 1Public Acts of 1943, Act No. 182 of the Public Acts of 1986, and2Act No. 234 of the Public Acts of 1992THE PUBLIC SCHOOL EMPLOY- 3 EES RETIREMENT ACT OF 1979, 1980 PA 300, MCL 38.1301 TO 38.1437, 4 THE STATE EMPLOYEES' RETIREMENT ACT, 1943 PA 240, MCL 38.1 TO 5 38.69, THE STATE POLICE RETIREMENT ACT OF 1986, 1986 PA 182, MCL 6 38.1601 TO 38.1648, AND THE JUDGES RETIREMENT ACT OF 1992, 1992 7 PA 234, MCL 38.2101 TO 38.2670, and members of these state 8 retirement systems only if the state treasurer makes an invest- 9 ment in the name of the respective retirement system to which 10 such members belong. 03332'97 Final page.
