HOUSE BILL No. 4979 June 26, 1997, Introduced by Reps. Lowe and Gernaat and referred to the Committee on Regulatory Affairs. A bill to authorize the department of natural resources to convey certain state owned property in Crawford county; to pre- scribe conditions for the conveyance; and to provide for disposi- tion of the revenue from the conveyance. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. The department of natural resources, on behalf of 2 the state, may convey to the township of Grayling, for considera- 3 tion of $1.00, property under the jurisdiction of the department 4 of natural resources and located in the township of Grayling, 5 Crawford county, Michigan, and further described as follows: 6 That portion of the SW 1/4 of the NE 1/4, lying north of the 7 AuSable River; and, that portion of the SE 1/4 of the NW 1/4, 8 lying north and east of the AuSable River; all within Section 10, 9 Township 26 North, Range 3 West. 01820'97 ** DRM 2 1 Sec. 2. The conveyance authorized by this act shall provide 2 for both of the following: 3 (a) That the property shall be used exclusively for public 4 purposes and that upon termination of that use or use for any 5 other purpose, the state may reenter and repossess the property, 6 terminating the grantee's estate in the property. 7 (b) That if the grantee disputes the state's exercise of its 8 right of reentry and fails to promptly deliver possession of the 9 property to the state, the attorney general, on behalf of the 10 state, may bring an action to quiet title to, and regain posses- 11 sion of, the property. 12 Sec. 3. The conveyance authorized by this act shall be by 13 quitclaim deed approved by the attorney general and shall convey 14 all rights held by the state to coal, oil, gas, and other miner- 15 als, excluding sand, gravel, clay, or other nonmetallic minerals 16 found on or under the property conveyed. 17 Sec. 4.
