     July 1, 1997, Introduced by Reps. DeVuyst, Goschka, Jellema, Horton, McManus, McBryde, Rhead, Voorhees, Jelinek, Bodem, Green, Hammerstrom, Dalman, Raczkowski, McNutt, Jaye, Walberg, Mans, Kilpatrick, LeTarte, Geiger, Oxender, Middleton and Gernaat and referred to the Committee on Conservation, Environment and Recreation.


        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   by amending section 43514 (MCL 324.43514), as added by 1995 PA

   57; and to repeal acts and parts of acts.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 43514.  (1) A resident  , the resident's spouse, and

 2     the resident's children  may hunt small game without a license

 3     upon the enclosed farmlands upon which they are regularly

 4     domiciled  ON FARMLAND OR OTHER LAND OWNED OR OPERATED BY THE

 5    RESIDENT, at a time and in a manner permitted by law; except that

 6     they  THE RESIDENT shall obtain a waterfowl hunting license for

 7    hunting waterfowl and a federal migratory bird hunting stamp as

 8    required by law.

 1         (2) AT ANY TIME, A RESIDENT OR A RESIDENT'S DESIGNEE MAY

 2    HUNT WOODCHUCK WITHOUT A LICENSE ON FARMLAND OWNED OR OPERATED BY

 3    THE RESIDENT.

 4         (3)  (2)  A resident  , the resident's spouse, and the

 5     resident's children  may fish without a license in water  wholly

 6     within the limits of their enclosed farmlands  LOCATED WHOLLY ON

 7    FARMLAND or other  enclosed lands upon which they are regularly

 8     domiciled  LAND OWNED OR OPERATED BY THE RESIDENT, at a time and

 9    in a manner permitted by law.

10         Enacting section 1.  Section 43512 of the natural resources

11    and environmental protection act, 1994 PA 451, MCL 324.43512, is

12    repealed.
