HOUSE BILL No. 5066


     September 23, 1997, Introduced by Reps. Lowe, Goschka, Horton and Llewellyn and referred to the Committee on Conservation, Environment and Recreation.


        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   by amending section 2104 (MCL 324.2104), as added by 1995 PA 60.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 2104.  (1) Any of the lands under the control of the

 2    department, the title to which is in this state and which may be

 3    sold and conveyed or are a part of the state lands, as well as

 4    lands later acquired by this state, or any part or portion of

 5    those lands, may be exchanged for lands of equal area or approxi-

 6    mately equal value belonging to the United States or owned by

 7    private individuals if in the opinion of the department it is in

 8    the interest of the state to do so.

 9         (2) IF THE DEPARTMENT CHARGES AN APPLICATION FEE FOR A

10    PROPOSED EXCHANGE OF LANDS UNDER THIS SECTION AND THE STATE LAND

11    PROPOSED FOR EXCHANGE IS SOLD TO ANOTHER PARTY WITHIN 3 YEARS

 2    THE APPLICATION FEE IN FULL TO THE APPLICANT.
