HOUSE BILL No. 5096


     September 25, 1997, Introduced by Reps. Dalman, Jelinek, LeTarte, Schauer, Kilpatrick and McNutt and referred to the Committee on Colleges and Universities.


        A bill to amend 1964 PA 208, entitled

   "An act to grant scholarships to students enrolled in postsecond-
   ary education institutions; and to provide for the administration
   of the scholarship program,"

   by amending section 3 (MCL 390.973), as amended by 1980 PA 500.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec.  3.  (1) The authority shall conduct a competitive

 2    examination among eligible applicants for state competitive

 3    scholarships at times and places as determined by the authority.

 4    The authority may designate a competitive examination to be

 5    administered among eligible applicants for state competitive

 6    scholarships.  The examination scores necessary to qualify for

 7    the competitive scholarship shall be established annually by the

 8    authority according to the funding available to meet the award

 9    levels established pursuant to section 6.

 1         (2)  The authority  IN ADDITION TO THE EXAMINATION SCORES

 2    DESCRIBED IN SUBSECTION (1), THE AUTHORITY SHALL CONSIDER TESTS

 3    OR ASSESSMENT INSTRUMENTS USED FOR STATE-ENDORSED DIPLOMAS UNDER

 4    SECTION 1279 OF THE REVISED SCHOOL CODE, 1976 PA 451, MCL

 5    380.1279, OR SECTION 104A OF THE STATE SCHOOL AID ACT OF 1979,

 6    1979 PA 94, MCL 388.1704A, AND may also  use  CONSIDER scholastic

 7    achievement in determining award winners.  and shall issue 

 8    ADDITIONALLY, THE AUTHORITY SHALL DO BOTH OF THE FOLLOWING:

 9         (A) ISSUE appropriate certificates of recognition to persons

10    awarded scholarships.  The authority shall grant 

11         (B) GRANT annual renewal of scholarships.

12         (3) Rules for the conduct of examinations for the award of

13    scholarships and the procedures for the awarding of annual

14    renewal scholarships shall be promulgated by the authority

15     pursuant to Act No.  306 of the Public Acts of 1969, as amended,

16     being sections 24.201 to 24.315 of the Michigan Compiled Laws 

17    UNDER THE ADMINISTRATIVE PROCEDURES ACT OF 1969, 1969 PA 306, MCL

18    24.201 TO 24.328.  The authority shall define postsecondary

19    institutions in the rules promulgated.
