A bill to amend 1972 PA 382, entitled "Traxler-McCauley-Law-Bowman bingo act," by amending section 3 (MCL 432.103), as amended by 1995 PA 275. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3. (1) "Educational organization" means an organiza- 2 tion within this state that is organized not for pecuniary 3 profit, whose primary purpose is educational in nature and 4 designed to develop the capabilities of individuals by instruc- 5 tion in any public or private elementary or secondary school that 6 complies with the school code of 1976, Act No. 451 of the Public 7 Acts of 1976, being sections 380.1 to 380.1852 of the Michigan 8 Compiled Laws REVISED SCHOOL CODE, 1976 PA 451, MCL 380.1 TO 9 380.1852, or any private or public college or university that is 10 organized not for pecuniary profit and that is approved by the 11 state board of education. 04046'97 VPW 2 1 (2) "Fraternal organization" means an organization within 2 this state, except a college fraternity or sorority, that is 3 organized not for pecuniary profit; that is a branch, lodge, or 4 chapter of a national or state organization; and that exists for 5 the common purpose, brotherhood, or other interests of its 6 members. FRATERNAL ORGANIZATION INCLUDES A REGISTERED INDEPEN- 7 DENT FRATERNAL ORGANIZATION. 8 (3) "Licensee" means a person or qualified organization 9 licensed pursuant to this act. 10 (4) "Member" means an individual who qualified for member- 11 ship in a qualified organization pursuant to its bylaws, articles 12 of incorporation, charter, rules, or other written statement. 13 (5) "Person" means a natural person, firm, association, cor- 14 poration, or other legal entity. 15 (6) "Qualified organization" means a bona fide religious, 16 educational, service, senior citizens, fraternal, or veterans' 17 organization that operates without profit to its members and that 18 either has been in existence continuously as an organization for 19 a period of 5 years or is exempt from taxation imposed by the 20 single business tax act, Act No. 228 of the Public Acts of 1975, 21 being sections 208.1 to 208.145 of the Michigan Compiled Laws 22 1975 PA 228, MCL 208.1 TO 208.145. Qualified organization does 23 not include a candidate committee, political committee, political 24 party committee, ballot question committee, independent commit- 25 tee, or any other committee as defined by, and organized pursuant 26 to, the Michigan campaign finance act, Act No. 388 of the Public 04046'97 3 1 Acts of 1976, being sections 169.201 to 169.282 of the Michigan 2 Compiled Laws 1976 PA 388, MCL 169.201 TO 169.282. 3 (7) "Religious organization" means any of the following: 4 (a) An organization, church, body of communicants, or group 5 that is organized not for pecuniary profit and that gathers in 6 common membership for mutual support and edification in piety, 7 worship, and religious observances. 8 (b) A society of individuals that is organized not for pecu- 9 niary profit and that unites for religious purposes at a definite 10 place. 11 (c) A church related private school that is organized not 12 for pecuniary profit. 13 (8) "Senior citizens organization" means an organization 14 within this state that is organized not for pecuniary profit, 15 that consists of at least 15 members who are 60 years of age or 16 older, and that exists for their mutual support and for the 17 advancement of the causes of elderly or retired persons. 18 (9) "Service organization" means either of the following: 19 (a) A branch, lodge, or chapter of a national or state 20 organization that is organized not for pecuniary profit and that 21 is authorized by its written constitution, charter, articles of 22 incorporation, or bylaws to engage in a fraternal, civic, or 23 service purpose within the state. 24 (b) A local civic organization that is organized not for 25 pecuniary profit; that is not affiliated with a state or national 26 organization; that is recognized by resolution adopted by the 27 local governmental subdivision in which the organization conducts 04046'97 4 1 its principal activities; whose constitution, charter, articles 2 of incorporation, or bylaws contain a provision for the perpetua- 3 tion of the organization as a nonprofit organization; whose 4 entire assets are pledged to charitable purposes; and whose con- 5 stitution, charter, articles of incorporation, or bylaws contain 6 a provision that all assets, real property, and personal property 7 shall revert to the benefit of the local governmental subdivision 8 that granted the resolution upon dissolution of the 9 organization. 10 (10) "Veterans' organization" means an organization within 11 this state, or a branch, lodge, or chapter within this state of a 12 state organization or of a national organization chartered by the 13 congress of the United States, that is organized not for pecuni- 14 ary profit, the membership of which consists of individuals who 15 were members of the armed services or forces of the United 16 States. 04046'97 Final page.
