HOUSE BILL No. 5141


     September 30, 1997, Introduced by Reps. Brackenridge, Birkholz, Crissman, Hammerstrom and Dobronski and referred to the Committee on Local Government.


        A bill to amend 1895 PA 3, entitled

   "The general law village act,"

   (MCL 61.1 to 74.25) by amending the title, as amended by 1983 PA

   44, and by adding section 14 to chapter III.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to provide for the incorporation of villages; to

 3    define their powers and duties; to provide for the levy and col-

 4    lection of taxes, borrowing of money, and issuance of bonds and

 5    other evidences of indebtedness by villages; to define the powers

 6    and duties of the municipal finance commission or its successor

 7    agency and of the department of treasury with regard thereto; to

 8    define the application of this act and provide for its amendment

 9    by villages subject thereto;  and  to validate prior amendments

 1    and certain prior actions taken and bonds issued by villages; AND

 2    TO PRESCRIBE PENALTIES AND PROVIDE REMEDIES.

 3                               CHAPTER III

 4         SEC. 14.  A PETITION UNDER SECTION 13 OF CHAPTER II, SECTION

 5    8 OF CHAPTER V, OR SECTION 18A OF CHAPTER XIV, INCLUDING THE CIR-

 6    CULATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488

 7    OF THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

 8    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

 9    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

10    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

11    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

12    168.992.

13         Enacting section 1.  This amendatory act does not take

14    effect unless Senate Bill No. _____ or House Bill No. _____

15    (request no. 02378'97) of the 89th Legislature is enacted into

16    law.
