HOUSE BILL No. 5159


     September 30, 1997, Introduced by Reps. Brewer, Brackenridge and Dobronski and referred to the Committee on Local Government.


        A bill to amend 1966 PA 298, entitled

   "An act to establish and provide a board of civil service commis-
   sioners for sheriffs' departments in certain counties; to provide
   a civil service system based upon examination and investigation
   as to merit, efficiency and fitness for appointment, employment
   and promotion of all officers and men appointed in the depart-
   ments; to regulate the transfer, reinstatement, suspension and
   discharge of said officers; and to provide for referendums,"

   (MCL 51.351 to 51.367) by amending the title and by adding sec-

   tion 16a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to establish and provide a board of civil service

 3    commissioners for sheriffs' departments in certain counties; to

 4    provide a civil service system based upon examination and inves-

 5    tigation as to merit, efficiency and fitness for appointment,

 6    employment and promotion of all officers and men appointed in the

 7    departments; to regulate the transfer, reinstatement, suspension

 1    and discharge of said officers;  and  to provide for referendums;

 2    AND TO PRESCRIBE PENALTIES AND PROVIDE REMEDIES.

 3         SEC. 16A.  A PETITION UNDER SECTION 16, INCLUDING THE CIRCU-

 4    LATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488 OF

 5    THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

 6    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

 7    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

 8    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

 9    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

10    168.992.

11         Enacting section 1.  This amendatory act does not take

12    effect unless Senate Bill No. _____ or House Bill No. _____

13    (request no. 02378'97) of the 89th Legislature is enacted into

14    law.
