        A bill to amend 1964 PA 284, entitled

   "City income tax act,"

   (MCL 141.501 to 141.787) by amending the title, as amended by

   1996 PA 478, and by adding section 3d to chapter 1.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to permit the imposition and collection by cities of

 3    an excise tax levied on or measured by income; to permit the col-

 4    lection and administration of the tax by the state; to provide

 5    the procedure including referendums for, and to require the adop-

 6    tion of a prescribed uniform city income tax ordinance by cities

 7    desiring to impose and collect such a tax; to limit the imposi-

 8    tion and collection by cities and villages of excise taxes levied

 9    on or measured by income; to prescribe the powers and duties of

10    certain state and municipal agencies, departments, and officials;

 1    to establish the city income tax trust fund;  and  to provide for

 2    appeals; AND TO PRESCRIBE PENALTIES AND PROVIDE REMEDIES.

 3                                CHAPTER 1

 4         SEC. 3D.  A PETITION UNDER SECTION 3, INCLUDING THE CIRCULA-

 5    TION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488 OF

 6    THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

 7    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

 8    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

 9    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

10    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

11    168.992.

12         Enacting section 1.  This amendatory act does not take

13    effect unless Senate Bill No. _____ or House Bill No. _____

14    (request no. 02378'97) of the 89th Legislature is enacted into

15    law.
