HOUSE BILL No. 5178

        A bill to amend 1929 PA 312, entitled

   "The metropolitan district act,"

   (MCL 119.1 to 119.18) by amending the title, as amended by 1989

   PA 98, and by adding section 9b.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to provide for the incorporation by any 2 or more

 3    cities, villages, or townships, or any combination or parts

 4    thereof, of a metropolitan district comprising territory within

 5    their limits for the purpose of acquiring, owning, and operating

 6    parks or public utilities for supplying sewage disposal, drain-

 7    age, water, or transportation, or any combination thereof; to

 8    provide that a district may sell or purchase sewage disposal,

 9    drainage rights, water, or transportation facilities; to provide

10    that a district may acquire and succeed to the rights,

 1    obligations, and property of such cities, villages, and townships

 2    respecting or connected with such functions or public utilities

 3    but subject to the approval of a majority of the electors voting

 4    thereon; to limit the rate of taxation of a district for its

 5    municipal purposes and restrict its powers of borrowing money and

 6    contracting debts; to provide the method and vote by which

 7    charters may be framed, adopted, and amended and laws and ordi-

 8    nances relating to its municipal concerns may be enacted; to

 9    define the powers, rights, and liabilities of a district;  and 

10    to provide for the dissolution of a district; AND TO PRESCRIBE

11    PENALTIES AND PROVIDE REMEDIES.

12         SEC. 9B.  A PETITION UNDER SECTION 9A OR 13, INCLUDING THE

13    CIRCULATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION

14    488 OF THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A

15    PERSON WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW,

16    1954 PA 116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION

17    DESCRIBED IN THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED

18    FOR THAT VIOLATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL

19    168.1 TO 168.992.

20         Enacting section 1.  This amendatory act does not take

21    effect unless Senate Bill No. _____ or House Bill No. _____

22    (request no. 02378'97) of the 89th Legislature is enacted into

23    law.
