HOUSE BILL No. 5181


     September 30, 1997, Introduced by Reps. Birkholz, Brackenridge and Hammerstrom and referred to the Committee on Local Government.


        A bill to amend 1957 PA 206, entitled

   "An act to authorize 2 or more counties, cities, townships and
   incorporated villages, or any combination thereof, to incorporate
   an airport authority for the planning, promoting, acquiring, con-
   structing, improving, enlarging, extending, owning, maintaining
   and operating the landing, navigational and building facilities
   necessary thereto of 1 or more community airports; to provide for
   changes in the membership therein; to authorize an authority or
   the counties, cities, townships and incorporated villages that
   form an authority to levy taxes for such purposes; to provide for
   the operation and maintenance and issuing notes therefor; and to
   authorize condemnation proceedings,"

   (MCL 259.621 to 259.631) by amending the title, as amended by

   1987 PA 153, and by adding section 8a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to authorize 2 or more counties, cities, townships

 3    and incorporated villages, or any combination thereof, to

 4    incorporate an airport authority for the planning, promoting,

 5    acquiring, constructing, improving, enlarging, extending, owning,

 1    maintaining and operating the landing, navigational and building

 2    facilities necessary thereto of 1 or more community airports; to

 3    provide for changes in the membership therein; to authorize an

 4    authority or the counties, cities, townships and incorporated

 5    villages that form an authority to levy taxes for such purposes;

 6    to provide for the operation and maintenance and issuing notes

 7    therefor;  and  to authorize condemnation proceedings; AND TO

 8    PRESCRIBE PENALTIES AND PROVIDE REMEDIES.

 9         SEC. 8A.  A PETITION UNDER SECTION 8, INCLUDING THE CIRCULA-

10    TION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488 OF

11    THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

12    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

13    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

14    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

15    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

16    168.992.

17         Enacting section 1.  This amendatory act does not take

18    effect unless Senate Bill No. _____ or House Bill No. _____

19    (request no. 02378'97) of the 89th Legislature is enacted into

20    law.
