     September 30, 1997, Introduced by Reps. Hammerstrom, Brackenridge, Crissman and Birkholz and referred to the Committee on Local Government.


        A bill to amend 1929 PA 199, entitled

   "An act to authorize and empower villages and townships of this
   state having a population not exceeding 10,000 inhabitants, to
   levy a tax for the maintenance or the purchase of lands and main-
   tenance of property for a community center for the benefit of the
   public, provided the question of such purchase or maintenance, or
   both purchase and maintenance, as the case may be, is submitted
   to the duly qualified voters of such villages or townships and is
   adopted by a majority vote of those participating in said
   election,"

   (MCL 123.41 to 123.46) by amending the title and by adding sec-

   tion 1a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to authorize and empower villages and townships of

 3    this state having a population not exceeding 10,000 inhabitants,

 4    to levy a tax for the maintenance or the purchase of lands and

 5    maintenance of property for a community center for the benefit of

 6    the public, provided the question of such purchase or

 1    maintenance, or both purchase and maintenance, as the case may

 2    be, is submitted to the duly qualified voters of such villages or

 3    townships and is adopted by a majority vote of those participat-

 4    ing in said election; AND TO PRESCRIBE PENALTIES AND PROVIDE

 5    REMEDIES.

 6         SEC. 1A.  A PETITION UNDER SECTION 1 OR 6, INCLUDING THE

 7    CIRCULATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION

 8    488 OF THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A

 9    PERSON WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW,

10    1954 PA 116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION

11    DESCRIBED IN THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED

12    FOR THAT VIOLATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL

13    168.1 TO 168.992.

14         Enacting section 1.  This amendatory act does not take

15    effect unless Senate Bill No. _____ or House Bill No. _____

16    (request no. 02378'97) of the 89th Legislature is enacted into

17    law.
