A bill to amend 1945 PA 47, entitled "An act to authorize 2 or more cities, townships, and villages, or any combination of cities, townships, and villages, to incor- porate a hospital authority for planning, promoting, acquiring, constructing, improving, enlarging, extending, owning, maintain- ing, and operating 1 or more community hospitals and related buildings or structures and related facilities; to provide for the sale, lease, or other transfer of a hospital owned by a hos- pital authority to a nonprofit corporation established under the laws of this state for no or nominal monetary consideration; to define hospitals and community hospitals; to provide for changes in the membership therein; to authorize the cities, townships, and villages to levy taxes for community hospital purposes; to provide for the issuance of bonds; to provide for the pledge of assessments; to provide for borrowing money for operation and maintenance and issuing notes for operation and maintenance; to validate elections heretofore held and notes heretofore issued; to validate bonds heretofore issued; to authorize condemnation proceedings; to grant certain powers of a body corporate; and to validate and ratify the organization, existence, and membership of entities acting as hospital authorities under the act and the actions taken by hospital authorities and by the members of the hospital authorities," (MCL 331.1 to 331.11) by amending the title, as amended by 1987 PA 117, and by adding section 10. 02378'97 eee KKR 2 1 THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 2 TITLE 3 An act to authorize 2 or more cities, townships, and vil- 4 lages, or any combination of cities, townships, and villages, to 5 incorporate a hospital authority for planning, promoting, acquir- 6 ing, constructing, improving, enlarging, extending, owning, main- 7 taining, and operating 1 or more community hospitals and related 8 buildings or structures and related facilities; to provide for 9 the sale, lease, or other transfer of a hospital owned by a hos- 10 pital authority to a nonprofit corporation established under the 11 laws of this state for no or nominal monetary consideration; to 12 define hospitals and community hospitals; to provide for changes 13 in the membership therein; to authorize the cities, townships, 14 and villages to levy taxes for community hospital purposes; to 15 provide for the issuance of bonds; to provide for the pledge of 16 assessments; to provide for borrowing money for operation and 17 maintenance and issuing notes for operation and maintenance; to 18 validate elections heretofore held and notes heretofore issued; 19 to validate bonds heretofore issued; to authorize condemnation 20 proceedings; to grant certain powers of a body corporate; and 21 to validate and ratify the organization, existence, and member- 22 ship of entities acting as hospital authorities under the act and 23 the actions taken by hospital authorities and by the members of 24 the hospital authorities; AND TO PRESCRIBE PENALTIES AND PROVIDE 25 REMEDIES. 26 SEC. 10. A PETITION UNDER SECTION 8C OR 9, INCLUDING THE 27 CIRCULATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 02378'97 eee 3 1 488 OF THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488. A 2 PERSON WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 3 1954 PA 116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION 4 DESCRIBED IN THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED 5 FOR THAT VIOLATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 6 168.1 TO 168.992. 7 Enacting section 1.
