A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1279 (MCL 380.1279), as amended by 1997 PA 25. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1279. (1) The board of a school district or public 2 school academy shall award a state-endorsed high school diploma 3 to an eligible high school graduate as provided in this section. 4 (2)For pupils scheduled to graduate from high school in51997, if a pupil achieves the academic objectives required by the6state board, as measured by an assessment developed under7subsection (7), for a state-endorsed high school diploma, or8meets the requirements described in former subsection (1)(c) for9a state-endorsed diploma, in 1 or more of the subject areas of10communications skills, mathematics, and science, the pupil's02811'97 * TAV 2 1school district or public school academy shall award a state2endorsement on the pupil's diploma in each of the subject areas3in which the pupil demonstrated the required proficiency.4Beginning with pupils scheduled to graduate in 1998, if aA 5 PUPIL'S SCHOOL DISTRICT OR PUBLIC SCHOOL ACADEMY SHALL AWARD A 6 STATE ENDORSEMENT ON THE PUPIL'S DIPLOMA IN EACH OF THE SUBJECT 7 AREAS OF COMMUNICATIONS SKILLS, MATHEMATICS, SCIENCE, AND, BEGIN- 8 NING WITH PUPILS SCHEDULED TO GRADUATE IN 2000, SOCIAL STUDIES, 9 IN WHICH THE PUPIL DEMONSTRATES THE REQUIRED PROFICIENCY ACCORD- 10 ING TO 1 OR MORE OF THE FOLLOWING: 11 (A) THE pupil achieves theobjectivesSCORE required by 12 the state board, as measured byON an assessment instrument 13 developed under subsection(7)(8),for a state-endorsed high14school diploma in 1 or more of the subject areas of communica-15tions skills, mathematics, science, and, beginning with pupils16scheduled to graduate in 2000, social studies, the pupil's school17district or public school academy shall award a state endorsement18on the pupil's diploma in each of the subject areas in which the19pupil demonstrated the required proficiency.20 (B) THE PUPIL ACHIEVES THE SCORE REQUIRED BY THE STATE BOARD 21 ON THE APPLICABLE PORTION OF THE ACT TEST. 22 (C) THE PUPIL ACHIEVES THE SCORE REQUIRED BY THE STATE BOARD 23 ON THE APPLICABLE PORTION OF THE SAT TEST. 24 (3) A school district or public school academy shall not 25 award a state endorsement to a pupil unless the pupil meets AT 26 LEAST 1 OF the applicable requirements for the endorsement, as 27 described inthissubsection (2). A school district or public 02811'97 * 3 1 school academy may award a high school diploma to a pupil who 2 successfully completes local school district or public school 3 academy requirements established in accordance with state law for 4 high school graduation, regardless of whether the pupil is eligi- 5 ble for any state endorsement. 6 (4)(3)A pupil who does not achieve the requirements of 7 subsection (2) may be reevaluated each school year until the 8 pupil achieves an applicable requirement for a state-endorsed 9 diploma. In addition, the board of the school district or public 10 school academy in which the pupil is enrolled shall provide that 11 there be at least 1 meeting attended by at least the pupil and a 12 member of the school district's or public school academy's staff 13 or a local or intermediate school district consultant who is pro- 14 ficient in the measurement and evaluation of pupils. The school 15 district or public school academy may provide the meeting as a 16 group meeting for pupils in similar circumstances. If the pupil 17 is a minor, the school district or public school academy shall 18 invite and encourage the pupil's parent, legal guardian, or 19 person in loco parentis to attend the meeting and shall mail a 20 notice of the meeting to the pupil's parent, legal guardian, or 21 person in loco parentis. The purpose of this meeting and any 22 subsequent meeting under this subsection shall be to determine an 23 educational program for the pupil designed to have the pupil 24 reach proficiency in each subject or skill area in which he or 25 she was assessed by the testing as not proficient. In addition, 26 a school district or public school academy may provide for 27 subsequent meetings with the pupil conducted by a high school 02811'97 * 4 1 counselor or teacher designated by the pupil's high school 2 principal, and shall invite and encourage the pupil's parent, 3 legal guardian, or person in loco parentis to attend the subse- 4 quent meetings. The school district or public school academy 5 shall provide special programs for the pupil or develop a program 6 using the educational programs regularly provided by the district 7 unless the board of the school district or public school academy 8 decides otherwise and publishes and explains its decision in a 9 public justification report. A pupil may be reevaluated at any 10 time the school district or public school academy administers an 11 applicable assessment instrument OR, FOR THE ACT TEST OR SAT 12 TEST, AT ANY TIME THE TEST IS ADMINISTERED. 13 (5)(4)For a state-endorsed diploma, a pupil must achieve 14 the requirements of subsection (2) in addition to any other 15 requirements established by law or by the board of the school 16 district or public school academy for a high school diploma. If 17 the board of a school district or public school academy deter- 18 mines that a pupil qualifies for a state-endorsed diploma, the 19 board shall indicate on the pupil's high school diploma and tran- 20 script that the pupil achieved the proficiency necessary for 21 receipt of a state-endorsed diploma. 22 (6)(5)An individual may repeat any of the tests or 23 assessment instruments specified in subsection (2) at any time 24 the school district or public school academy regularly offers the 25 test or assessment OR, FOR THE ACT TEST OR SAT TEST, AT ANY TIME 26 THE TEST IS ADMINISTERED. If an individual described in this 27 subsection achieves the requirements of subsection (2) and 02811'97 * 5 1 completes all other applicable requirements for a high school 2 diploma, the individual shall be awarded a state-endorsed diploma 3 as otherwise provided in this section. 4 (7)(6)A school district or public school academy shall 5 provide accommodations to a pupil with disabilities for the pro- 6 ficiency testing or assessment required under this section AND 7 ADMINISTRATED BY THE SCHOOL DISTRICT OR PUBLIC SCHOOL ACADEMY, as 8 provided under section 504 of title V of the rehabilitation act 9 of 1973, Public Law 93-112, 29 U.S.C. 794; subtitle A of title II 10 of the Americans with disabilities act of 1990, Public Law 11 101-336, 42 U.S.C. 12131 to 12134; and the implementing regula- 12 tions for those statutes. 13 (8)(7)For the purposes of this section, the state board 14 shall develop or select and approve assessment instruments to 15 determine pupil proficiency in communications skills, mathemat- 16 ics, social studies, and science. The assessment instruments 17 shall be based on the state board model core academic content 18 standards objectives. 19 (9)(8)All assessment instruments developed or selected 20 and approved by the state under any statute or rule for a purpose 21 related to K to 12 education shall be objective-oriented and con- 22 sistent with the state board model core academic content stan- 23 dards objectives. 24 (10)(9)Upon payment of a reasonable fee any person may 25 taketheA state-endorsed diploma test DESCRIBED IN SUBSECTION 26 (8) and, upon demonstrating the required proficiency in a subject 02811'97 * 6 1 area, have his or her high school diploma state-endorsed for that 2 subject area. 3 (11) AS USED IN THIS SECTION: 4 (A) "ACT TEST" MEANS THE ACT TEST ADMINISTERED BY ACT, INC. 5 (B) "SAT TEST" MEANS THE SCHOLASTIC APTITUDE TEST ADMINIS- 6 TERED BY THE COLLEGE BOARD. 02811'97 * Final page.
