A bill to amend 1979 PA 94, entitled "The state school aid act of 1979," by amending section 104a (MCL 388.1704a), as amended by 1997 PA 24. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 104a. (1) In order to receive state aid under this 2 act, a district shall comply with this section and shall award a 3 state-endorsed high school diploma to an eligible graduate as 4 provided in this section. 5 (2) For pupils scheduled to graduate in 1997, if a pupil 6 achieves the outcomes required by the state board, as measured by 7 an assessment developed under subsection (7), for a 8 state-endorsed high school diploma, or meets the requirements 9 described in former subsection (1)(c) for a state-endorsed high 10 school diploma, in 1 or more of the subject areas of 02811'97 a * TAV 2 1 communications skills, mathematics, and science, the pupil's 2 district shall award a state endorsement on the pupil's diploma 3 in each of the subject areas in which the pupil demonstrated the 4 required proficiency. Beginning with pupils scheduled to gradu- 5 ate in 1998, if a A PUPIL'S DISTRICT SHALL AWARD A STATE 6 ENDORSEMENT ON THE PUPIL'S DIPLOMA IN EACH OF THE SUBJECT AREAS 7 OF COMMUNICATIONS SKILLS, MATHEMATICS, SCIENCE, AND, BEGINNING 8 WITH PUPILS SCHEDULED TO GRADUATE IN 2000, SOCIAL STUDIES, IN 9 WHICH THE PUPIL DEMONSTRATES THE REQUIRED PROFICIENCY ACCORDING 10 TO 1 OR MORE OF THE FOLLOWING: 11 (A) THE pupil achieves the objectives SCORE required by 12 the state board , as measured by ON an assessment instrument 13 developed under subsection (8). (7), for a state-endorsed high 14 school diploma in 1 or more of the subject areas of communica- 15 tions skills, mathematics, science, and, beginning with pupils 16 scheduled to graduate in 2000, social studies, the pupil's dis- 17 trict shall award a state endorsement on the pupil's diploma in 18 each of the subject areas in which the pupil demonstrated the 19 required proficiency. 20 (B) THE PUPIL ACHIEVES THE SCORE REQUIRED BY THE STATE BOARD 21 ON THE APPLICABLE PORTION OF THE ACT TEST. 22 (C) THE PUPIL ACHIEVES THE SCORE REQUIRED BY THE STATE BOARD 23 ON THE APPLICABLE PORTION OF THE SAT TEST. 24 (3) A district shall not award a state endorsement to a 25 pupil unless the pupil meets AT LEAST 1 OF the applicable 26 requirements for the endorsement, as described in this 27 subsection (2). A school district may award a high school 02811'97 a * 3 1 diploma to a pupil who successfully completes local district 2 requirements established in accordance with state law for high 3 school graduation, regardless of whether the pupil is eligible 4 for any state endorsement. 5 (4) (3) A pupil who does not achieve the requirements of 6 subsection (2) may be reevaluated each school year until the 7 pupil achieves an applicable requirement for a state-endorsed 8 diploma. In addition, the board of the district in which the 9 pupil is enrolled shall provide that there be at least 1 meeting 10 attended by at least the pupil and a member of the district's 11 staff or a local or intermediate district consultant who is pro- 12 ficient in the measurement and evaluation of pupils. The dis- 13 trict may provide the meeting as a group meeting for pupils in 14 similar circumstances. If the pupil is a minor, the district 15 shall invite and encourage the pupil's parent, legal guardian, or 16 person in loco parentis to attend the meeting and shall mail a 17 notice of the meeting to the pupil's parent, legal guardian, or 18 person in loco parentis. The purpose of this meeting and any 19 subsequent meeting under this subsection shall be to determine an 20 educational program for the pupil designed to have the pupil 21 reach proficiency in each subject or skill area in which he or 22 she was assessed by the testing as not proficient. In addition, 23 a district may provide for subsequent meetings with the pupil 24 conducted by a high school counselor or teacher designated by the 25 pupil's high school principal, and shall invite and encourage the 26 pupil's parent, legal guardian, or person in loco parentis to 27 attend the subsequent meetings. The district shall provide 02811'97 a * 4 1 special programs for the pupil or develop a program using the 2 educational programs regularly provided by the district unless 3 the board of the district decides otherwise and publishes and 4 explains its decision in a public justification report. A pupil 5 may be reevaluated at any time the district administers an appli- 6 cable assessment instrument OR, FOR THE ACT TEST OR SAT TEST, AT 7 ANY TIME THE TEST IS ADMINISTERED. 8 (5) (4) For a state-endorsed diploma, a pupil must achieve 9 the requirements of subsection (2) in addition to any other 10 requirements established by law or by the board of a district for 11 a high school diploma. If the board of a district determines 12 that a pupil qualifies for a state-endorsed diploma, the board 13 shall indicate on the pupil's high school diploma and transcript 14 that the pupil achieved the proficiency necessary for receipt of 15 a state-endorsed diploma. 16 (6) (5) An individual may repeat any of the tests or 17 assessment instruments specified in subsection (2) at any time 18 the district regularly offers the test or assessment OR, FOR THE 19 ACT TEST OR SAT TEST, AT ANY TIME THE TEST IS ADMINISTERED. If 20 an individual described in this subsection achieves the require- 21 ments of subsection (2) and completes all other applicable 22 requirements for a high school diploma, the individual shall be 23 awarded a state-endorsed diploma as otherwise provided in this 24 section. 25 (7) (6) A district shall provide accommodations to a pupil 26 with disabilities for the proficiency testing or assessment 27 required under this section AND ADMINISTERED BY THE DISTRICT, as 02811'97 a * 5 1 provided under section 504 of title V of the rehabilitation act 2 of 1973, Public Law 93-112, 29 U.S.C. 794; subtitle A of title II 3 of the Americans with disabilities act of 1990, Public Law 4 101-336, 42 U.S.C. 12131 to 12134; and the implementing regula- 5 tions for those statutes. 6 (8) (7) For the purposes of this section, the state board 7 shall develop or select and approve assessment instruments to 8 determine pupil proficiency in communications skills, mathemat- 9 ics, social studies, and science. The assessment instruments 10 shall be based on the state board model core academic content 11 standards objectives. 12 (9) (8) Upon written request by the pupil's parent or 13 legal guardian stating that the request is being made for the 14 purpose of providing the pupil with an opportunity to qualify to 15 take 1 or more postsecondary courses as an eligible student under 16 the postsecondary enrollment options act, 1996 PA 160, MCL 17 388.511 to 388.524, the board of a district shall allow a pupil 18 who is in at least grade 10 to take a test or assessment 19 described in subsection (2) (8) without charge at any time the 20 district regularly administers the test or assessment or adminis- 21 ters a retest of the test or assessment. A district is not 22 required to include in an annual education report, or in any 23 other report submitted to the department for accreditation pur- 24 poses, results of tests or assessments taken under this subsec- 25 tion by a pupil in grade 10 or lower. 26 (10) (9) All assessment instruments developed or selected 27 and approved by the state under any statute or rule for a purpose 02811'97 a * 6 1 related to K to 12 education shall be objective-oriented and 2 consistent with the state board model core academic content stan- 3 dards objectives. 4 (11) (10) Upon payment of a reasonable fee any person may, 5 after graduation from high school, retake the A state-endorsed 6 diploma test DESCRIBED IN SUBSECTION (8) and, upon demonstrating 7 the required proficiency in a subject area, have his or her high 8 school diploma state-endorsed for that subject area. 9 (12) AS USED IN THIS SECTION: 10 (A) "ACT TEST" MEANS THE ACT TEST ADMINISTERED BY ACT, INC. 11 (B) "SAT TEST" MEANS THE SCHOLASTIC APTITUDE TEST ADMINIS- 12 TERED BY THE COLLEGE BOARD. 02811'97 a * Final page.
