HOUSE BILL No. 5366 November 13, 1997, Introduced by Reps. A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 43553, 47332, and 48737 (MCL 324.43553, 324.47332, and 324.48737), section 43553 as amended by 1996 PA 585 and sections 47332 and 48737 as added by 1995 PA 57, and by adding section 43555a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 43553. (1) Except as provided in sections 43555 and 24355643555A, the department shall transmit all money received 3 from the sale of licenses to the state treasurer, together with a 4 statement indicating the amount of money received and the source 5 of the money. 6 (2) The game and fish protection fund is created as a 7 separate fund in the department of treasury. Except as provided 8 in subsection (5), the state treasurer shall credit the money 03833'97 TMV 2 1 received from the sale of passbooks and licenses to the game and 2 fish protection fund. 3 (3) Except as provided in sections 43524, 43525,43531,4 AND 43554, and 43556and subsection (4), money credited to the 5 game and fish protection fund shall be paid out by the state 6 treasurer pursuant to the accounting laws of this state for the 7 following purposes: 8 (a) Services rendered by the department, together with the 9 expenses incurred in the enforcement and administration of the 10 game, fish, and fur laws of the state, including the necessary 11 equipment and apparatus incident to the operation and enforcement 12 of the game, fish, and fur laws, and the protection, propagation, 13 distribution, and control of game, fish, birds, fur-bearing ani- 14 mals, and other wildlife forms. 15 (b) The propagation and liberation of game, fur-bearing ani- 16 mals, birds, or fish and for their increase at the time, place, 17 and manner as the department considers advisable. 18 (c) The purchase, lease, and management of lands, together 19 with the necessary equipment for the purpose of propagating and 20 rearing game, fur-bearing animals, birds, or fish, and for estab- 21 lishing and maintaining game refuges, wildlife sanctuaries, and 22 public shooting and fishing grounds. 23 (d) Conducting investigations and compiling and publishing 24 information relative to the propagation, protection, and conser- 25 vation of wildlife. 03833'97 3 1 (e) Delivering lectures, developing cooperation, and 2 carrying on appropriate educational activities relating to the 3 conservation of the wildlife of this state. 4 (4) The department may make direct grants to colleges and 5 universities in this state, out of funds appropriated from the 6 game and fish protection fund, to conduct fish or wildlife 7 research or both fish and wildlife research. 8 (5) The youth hunting and fishing education and outreach 9 fund is created as a separate fund in the department of 10 treasury. The state treasurer shall credit to the youth hunting 11 and fishing education and outreach fund the money received from 12 the sale of small game licenses and all-species fishing licenses 13 under sections 43523 and 43532, respectively, to persons who are 14 12 years of age through 16 years of age. Money in the youth 15 hunting and fishing education and outreach fund at the close of 16 the fiscal year shall remain in the fund and shall not lapse to 17 the general fund. 18 (6) Money credited to the youth hunting and fishing educa- 19 tion and outreach fund shall be paid out by the state treasurer 20 pursuant to the accounting laws of this state for hunting and 21 fishing education and outreach programs for youth through 16 22 years of age. 23 (7) The department and any other executive department of the 24 state that receives money from the game and fish protection fund 25 or the youth hunting and fishing education and outreach fund 26 shall submit an annual report to the legislature showing the 27 amount of money received by the department or other executive 03833'97 4 1 department from the game and fish protection fund or the youth 2 hunting and fishing education and outreach fund and how that 3 money was spent. An executive department required to submit a 4 report as provided in this subsection shall send a copy of the 5 report to the legislature and to the department. 6 SEC. 43555A. (1) TWENTY-FIVE CENTS FROM EACH LICENSE AND 7 STAMP FEE PRESCRIBED IN THIS PART, PART 473, OR PART 487, EXCEPT 8 FOR FEES FOR LICENSES DESCRIBED IN SECTION 43553(5), SHALL BE 9 TRANSMITTED TO THE DEPARTMENT FOR DEPOSIT IN THE HUNTING AND 10 FISHING HARASSMENT PREVENTION FUND CREATED IN THIS SECTION. 11 (2) THE HUNTING AND FISHING HARASSMENT PREVENTION FUND IS 12 CREATED AS A SEPARATE FUND WITHIN THE STATE TREASURY. THE STATE 13 TREASURER SHALL CREDIT THE MONEY RECEIVED FROM THE DEPARTMENT 14 UNDER THIS SECTION TO THE HUNTING AND FISHING HARASSMENT PREVEN- 15 TION FUND. THE MONEY IN THE FUND SHALL BE EXPENDED BY THE 16 DEPARTMENT FOR THE FOLLOWING PURPOSES: 17 (A) REWARDS FOR INFORMATION LEADING TO THE ARREST AND PROSE- 18 CUTION OF PERSONS VIOLATING SECTION 40112, 47301A, OR 48702A. 19 (B) A PROMOTIONAL AND EDUCATIONAL CAMPAIGN TO INFORM THE 20 GENERAL PUBLIC ON 1 OR MORE OF THE FOLLOWING: 21 (i) THE REQUIREMENTS OF SECTIONS 40112, 47301A, 48702A, AND 22 48702B. 23 (ii) THE REWARD UNDER SUBDIVISION (A). 24 (3) AT THE TIME A PERSON PURCHASES A LICENSE OR STAMP UNDER 25 THIS PART OR PART 473, HE OR SHE MAY MAKE A VOLUNTARY CONTRIBU- 26 TION IN ANY AMOUNT TO THE HUNTING AND FISHING HARASSMENT 27 PREVENTION FUND TO BE EXPENDED FOR THE PURPOSES PROVIDED IN 03833'97 5 1 SUBSECTION (2). A PERSON WHO WISHES TO MAKE SUCH A CONTRIBUTION 2 MAY PURCHASE 1 OR MORE CONSERVATION LAW ENFORCEMENT STAMPS FROM A 3 PERSON AUTHORIZED TO ISSUE LICENSES AND SPORTCARDS UNDER THIS 4 PART. 5 (4) THE DEPARTMENT SHALL ANNUALLY REPORT TO THE LEGISLATURE 6 ON THE EXPENDITURES FROM THE HUNTING AND FISHING HARASSMENT PRE- 7 VENTION FUND. 8 Sec. 47332. (1) All licensesin effect after July 1, 19469 expire on December 31 in the calendar year for which issued. 10However, any license which expires December 31, 1946, shall be11issued for 1/2 the fee prescribed in section 47330.12 (2) The department shall keep a record of all applications 13 and licenses. On the first day of each month, the department 14 shall pay over to the state treasurer all money received by the 15 department under this part., andEXCEPT AS PROVIDED IN SECTION 16 43555A, the money shall be credited to the game and fish protec- 17 tion fund created inpart 435SECTION 43553 and shall be dis- 18 bursed by the state treasurer for services of the department and 19 the department's expenses in enforcing the commercial fishing 20 laws, for the protection and propagation of fish, and for the 21 purchase of patrol boats and other apparatus to be used for that 22 purpose, and as otherwise provided by law. 23 Sec. 48737. All money collected from the sale of licenses 24 and stamps as provided in this part shall be paid over to the 25 state treasurer by the department.and held to the credit of26 EXCEPT AS PROVIDED IN SECTION 43555A, THE MONEY SHALL BE CREDITED 27 TO the game and fish protection fund created inpart 43503833'97 6 1 SECTION 43553, and shall be used for the purposes necessary to 2 the protection, propagation, and distribution of fish and game 3 and as otherwise provided by law. 03833'97 Final page.
