A bill to create the state school technology commission within the department of education; to prescribe its powers and duties; and for related purposes. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "state school technology commission act". 3 Sec. 2. As used in this act: 4 (a) "Commission" means the state school technology commis- 5 sion created under section 3. 6 (b) "Department" means the department of education. 7 (c) "Intermediate school district" means that term as 8 defined in section 5 of the revised school code, 1976 PA 451, 9 MCL 380.5. 03315'97 TAV 2 1 (d) "School district" means a school district or local act 2 school district, as those terms are defined in the revised school 3 code, 1976 PA 451, MCL 380.1 to 380.1852. 4 Sec. 3. (1) The state school technology commission is cre- 5 ated within the department. 6 (2) The commission shall consist of 8 members as follows: 7 (a) The president of the state board of education or his or 8 her designee. 9 (b) The director of the department of management and budget 10 or his or her designee. 11 (c) The following 6 members appointed by the governor: 12 (i) Two members representing the private sector. 13 (ii) Four members representing public education, at least 2 14 of whom shall represent school districts and at least 2 of whom 15 shall represent intermediate school districts. 16 (3) The members first appointed to the commission shall be 17 appointed within 60 days after the effective date of this act. 18 (4) Members of the commission appointed under subsection 19 (2)(c) shall serve for terms of 3 years or until a successor is 20 appointed, whichever is later, except that of the members first 21 appointed 2 shall serve for 1 year, 2 shall serve for 2 years, 22 and 2 shall serve for 3 years. 23 (5) If a vacancy occurs among the appointed members on the 24 commission, the governor shall make an appointment for the unex- 25 pired term in the same manner as the original appointment. 26 (6) The governor may remove a member of the commission 27 appointed under subsection (2)(c) for incompetency, dereliction 03315'97 3 1 of duty, malfeasance, misfeasance, or nonfeasance in office, or 2 any other good cause. 3 (7) The first meeting of the commission shall be called by 4 the president of the state board of education. At the first 5 meeting, the commission shall elect from among its members a 6 chairperson and other officers as it considers necessary or 7 appropriate. After the first meeting, the commission shall meet 8 at least quarterly, or more frequently at the call of the chair- 9 person or if requested by a majority of its members. 10 (8) A majority of the members of the commission constitute a 11 quorum for the transaction of business at a meeting of the 12 commission. A majority of the members present and serving are 13 required for official action of the commission. 14 (9) The business that the commission may perform shall be 15 conducted at a public meeting of the commission held in compli- 16 ance with the open meetings act, 1976 PA 267, MCL 15.261 to 17 15.275. 18 (10) A writing prepared, owned, used, in the possession of, 19 or retained by the commission in the performance of an official 20 function is subject to the freedom of information act, 1976 21 PA 442, MCL 15.231 to 15.246. 22 (11) Members of the commission shall serve without 23 compensation. However, members of the commission may be reim- 24 bursed for their actual and necessary expenses incurred in the 25 performance of their official duties as members of the 26 commission. 03315'97 4 1 (12) The commission shall do all of the following: 2 (a) Develop a statewide school technology plan to improve 3 Michigan's school technology capability. 4 (b) Develop a model state school technology system. 5 (c) Develop a model internet usage policy for school staff 6 and pupils. 7 (d) Ascertain and evaluate the current status of school 8 technology in this state. 9 (e) Develop professional development models for training 10 teachers and other staff in technology. 11 (f) Gather information and report on usage of universal 12 service funds received by public schools. 13 (g) Identify issues concerning distance learning programs. 14 (13) Not later than November 1, 2000, and not later than 15 November 1 of each even numbered year thereafter, the commission 16 shall develop and submit to the governor, the legislature, and 17 the state board of education a report on its activities and its 18 recommendations concerning the matters described in subsection 19 (12). 03315'97 Final page.
