A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 314 (MCL 257.314), as amended by 1989 PA 299. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 314. (1) Except as OTHERWISE provided in subsections 2 (2), (3), (4), (5), and (6) THIS SECTION, an operator's license 3 shall expire on the birthday of the person to whom the license is 4 issued in the fourth year following the date of the issuance of 5 the license unless suspended or revoked before that date or 6 issued pursuant to UNDER section 314b. A license shall not be 7 issued for a period longer than 4 years. A person holding a 8 license at any time within 45 days before the expiration of his 9 or her license may make application for a new license as provided 10 for in this chapter. Beginning November 15, 1989 through 03373'97 TJS 2 1 March 31, 1992, a person who has a license with a class 1, 2 class 2, or class 3 indorsement may make application for renewal 3 of his or her license 90 days before expiration of the license. 4 However, a knowledge test for an original group designation or 5 indorsement may be taken at any time during this period and the 6 results shall be valid for 12 months. However, if the licensee 7 will be out of the state during the 45 days immediately preceding 8 expiration of the license or for other good cause shown cannot 9 apply for a license within the 45-day period, application for a 10 new license may be made not more than 6 months before expiration 11 of the license. This new license when granted shall expire as 12 provided for in this chapter. 13 (2) EFFECTIVE OCTOBER 1, 1997, THE FIRST OPERATOR'S LICENSE 14 ISSUED TO A PERSON WHO AT THE TIME OF APPLICATION IS LESS THAN 18 15 YEARS OF AGE SHALL EXPIRE ON THE LICENSEE'S EIGHTEENTH BIRTHDAY 16 UNLESS SUSPENDED OR REVOKED. THE SECRETARY OF STATE SHALL CODE 17 THE LICENSE IN A MANNER THAT CLEARLY IDENTIFIES THE LICENSEE AS 18 BEING LESS THAN 18 YEARS OF AGE. 19 (3) (2) Effective October 1, 1985 1997, the first 20 operator's license issued to a person who at the time of applica- 21 tion is NOT LESS THAN 18 YEARS OF AGE BUT less than 20-1/2 years 22 of age shall expire on the licensee's twenty-first birthday 23 unless suspended or revoked. The secretary of state shall code 24 the license in a manner which THAT clearly identifies the 25 licensee as being less than 21 years of age. 26 (3) The first chauffeur's license issued to a person shall 27 expire on the licensee's birthday in the fourth year following 03373'97 3 1 the date of issuance unless the license is suspended or revoked 2 before that date or is issued pursuant to UNDER section 314b. 3 Effective October 1, 1985, the THE chauffeur's license of a 4 person who at the time of application is less than 20-1/2 years 5 of age shall expire on the licensee's twenty-first birthday 6 unless suspended or revoked. The secretary of state shall code 7 the license in a manner which THAT clearly identifies the 8 licensee as being less than 21 years of age. A subsequent 9 chauffeur's license shall expire on the birthday of the person to 10 whom the license is issued in the fourth year following the date 11 of issuance of the license unless the license is suspended or 12 revoked before that date or is issued pursuant to UNDER section 13 314b. 14 (4) A person may apply for an extension of his or her driv- 15 ing privileges if he or she is out of state on the date that his 16 or her operator's or chauffeur's license expires. The extension 17 may extend the license for 90 days beyond the expiration date or 18 within 2 weeks after the applicant returns to Michigan, whichever 19 occurs first. 20 (5) A person who will be out of state for more than 90 days 21 beyond the expiration date of his or her operator's license may 22 apply for a 2-year extension of his or her driving privileges. 23 The applicant for this extension shall submit a statement evi- 24 dencing a vision examination in accordance with the rules promul- 25 gated by the secretary of state under section 309. The fee for a 26 2-year extension shall be the same as provided in section 27 314b(2). 03373'97 4 1 (6) A person whose operator's or chauffeur's license is 2 unexpired but whose class 1, class 2, or class 3 indorsement has 3 expired pursuant to section 312e(8) 312E(10) may apply for a 4 vehicle group designation or indorsement. Upon proper applica- 5 tion and payment of the fees prescribed in FORMER section 312g or 6 314b and section 811, the expiration of the person's operator's 7 or chauffeur's license shall be extended for 4 years beyond the 8 expiration which would have applied except for the operation of 9 section 312e(8) 312E(10). 03373'97 Final page.
