A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1280 (MCL 380.1280), as amended by 1997 PA 180, and by adding section 1277b. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 1277B. THE BOARD OF A SCHOOL DISTRICT OR A LOCAL ACT 2 SCHOOL DISTRICT OR THE BOARD OF DIRECTORS OF A PUBLIC SCHOOL 3 ACADEMY SHALL DO ALL OF THE FOLLOWING: 4 (A) PROVIDE TO PUPILS AN INTEGRATED CURRICULUM AND 5 GRADE-APPROPRIATE INSTRUCTION IN METHODS AND STRATEGIES OF VIO- 6 LENCE PREVENTION THAT LINK EDUCATIONAL, SOCIAL, AND HEALTH PRO- 7 GRAMS THAT REDUCE THE BARRIERS TO LEARNING. 8 (B) COORDINATE HEALTH AND SAFETY SERVICES FOR PUPILS FROM 9 EARLY CHILDHOOD PROGRAMS THROUGH HIGH SCHOOL, USING COLLABORATIVE 10 EFFORTS WITH LOCAL COMMUNITY HEALTH, MENTAL HEALTH, SOCIAL 05847'98 TAV 2 1 SERVICES, AND LAW ENFORCEMENT AGENCIES TO PROVIDE EARLY 2 INTERVENTION, TREATMENT, AND COLLABORATIVE SERVICES FOR PUPILS 3 WHO NEED ASSISTANCE. 4 (C) ESTABLISH AND MAINTAIN A DISRUPTIVE PUPIL REFERRAL AND 5 TREATMENT PROCESS INVOLVING INTERAGENCY PARTICIPATION AND 6 ASSISTANCE. 7 (D) ESTABLISH AND MAINTAIN A SYSTEM FOR PARENTAL INVOLVEMENT 8 IN ALL AREAS OF VIOLENCE INTERVENTION, PREVENTION, TREATMENT, AND 9 PUNISHMENT. 10 (E) DEVELOP A COORDINATED STAFF, ADMINISTRATOR, AND BOARD 11 MEMBER TRAINING PROGRAM IN INSTRUCTION, ROLES, RESPONSIBILITIES, 12 AND PROCESS IN ALL AREAS REGARDING SCHOOL DISCIPLINE. 13 Sec. 1280. (1) The board of a school district that does not 14 want to be subject to the measures described in this section 15 shall ensure that each public school within the school district 16 is accredited. 17 (2) As used in subsection (1), and subject to subsection 18 (6), "accredited" means certified by the state board as having 19 met or exceeded state board-approved standards established for 6 20 areas of school operation: administration and school organiza- 21 tion, curricula, staff, school plant and facilities, school and 22 community relations, and school improvement plans and student 23 performance. The building-level evaluation used in the accredit- 24 ation process shall include, but is not limited to, school data 25 collection, self-study, visitation and validation, determination 26 of performance data to be used, and the development of a school 27 improvement plan. 05847'98 3 1 (3) The department shall develop and distribute to all 2 public schools proposed accreditation standards. Upon distribu- 3 tion of the proposed standards, the department shall hold state- 4 wide public hearings for the purpose of receiving testimony con- 5 cerning the standards. After a review of the testimony, the 6 department shall revise and submit the proposed standards to the 7 state board. After a review and revision, if appropriate, of the 8 proposed standards, the state board shall submit the proposed 9 standards to the senate and house committees that have the 10 responsibility for education legislation. Upon approval by these 11 committees, the department shall distribute to all public schools 12 the standards to be applied to each school for accreditation 13 purposes. 14 (4) The department shall develop and distribute to all 15 public schools standards for determining that a school is eligi- 16 ble for summary accreditation under subsection (6). The stan- 17 dards shall be developed, reviewed, approved, and distributed 18 using the same process as prescribed in subsection (3) for 19 accreditation standards, and shall be finally distributed and 20 implemented not later than December 31, 1994. 21 (5) The standards for accreditation or summary accreditation 22 under this section shall include pupil performance on Michigan 23 education assessment program (MEAP) tests and the percentage of 24 pupils achieving state endorsement under section 1279 as cri- 25 teria, but shall not be based solely on pupil performance on MEAP 26 tests or on the percentage of pupils achieving state endorsement 27 under section 1279. The standards shall also include multiple 05847'98 4 1 year change in pupil performance on MEAP tests and multiple year 2 change in the percentage of pupils achieving state endorsement 3 under section 1279 as criteria. If it is necessary for the state 4 board to revise accreditation or summary accreditation standards 5 established under subsection (3) or (4) to comply with this sub- 6 section, the revised standards shall be developed, reviewed, 7 approved, and distributed using the same process as prescribed in 8 subsection (3). 9 (6) If the department determines that a public school has 10 met the standards established under subsection (4) or (5) THIS 11 SECTION for summary accreditation, the school is considered to be 12 accredited without the necessity for a full building-level evalu- 13 ation under subsection (2). 14 (7) If the department determines that a school has not met 15 the standards established under subsection (4) or (5) THIS 16 SECTION for summary accreditation but that the school is making 17 progress toward meeting those standards, or if, based on a full 18 building-level evaluation under subsection (2), the department 19 determines that a school has not met the standards for accredit- 20 ation but is making progress toward meeting those standards, the 21 school is in interim status and is subject to a full 22 building-level evaluation as provided in this section. 23 (8) If a school has not met the standards established under 24 subsection (4) or (5) THIS SECTION for summary accreditation 25 and is not eligible for interim status under subsection (7), the 26 school is unaccredited and subject to the measures provided in 27 this section. 05847'98 5 1 (9) THE STANDARDS FOR ACCREDITATION OR SUMMARY ACCREDITATION 2 UNDER THIS SECTION SHALL INCLUDE THE PROGRESS BEING MADE BY THE 3 SCHOOL DISTRICT IN IMPLEMENTING THE REQUIREMENTS OF SECTION 1277B 4 IN THE SCHOOL. IF IT IS NECESSARY FOR THE STATE BOARD TO REVISE 5 ACCREDITATION OR SUMMARY ACCREDITATION STANDARDS ESTABLISHED 6 UNDER SUBSECTION (3) OR (4) TO COMPLY WITH THIS SUBSECTION, THE 7 REVISED STANDARDS SHALL BE DEVELOPED, REVIEWED, APPROVED, AND 8 DISTRIBUTED USING THE SAME PROCESS AS PRESCRIBED IN SUBSECTION 9 (3). 10 (10) (9) The department shall annually review and evaluate 11 for accreditation purposes the performance of each school that is 12 unaccredited and as many of the schools that are in interim 13 status as permitted by the department's resources. 14 (11) (10) The department shall, and the intermediate 15 school district to which a school district is constituent, a con- 16 sortium of intermediate school districts, or any combination 17 thereof may, provide technical assistance, as appropriate, to a 18 school that is unaccredited or that is in interim status upon 19 request of the board of the school district in which the school 20 is located. If requests to the department for technical assist- 21 ance exceed the capacity, priority shall be given to unaccredited 22 schools. 23 (12) (11) A school that has been unaccredited for 3 con- 24 secutive years is subject to 1 or more of the following measures, 25 as determined by the superintendent of public instruction: 26 (a) The superintendent of public instruction or his or her 27 designee shall appoint at the expense of the affected school 05847'98 6 1 district an administrator of the school until the school becomes 2 accredited. 3 (b) A parent, legal guardian, or person in loco parentis of 4 a child who attends the school may send his or her child to any 5 accredited public school with an appropriate grade level within 6 the school district. 7 (c) The school, with the approval of the superintendent of 8 public instruction, shall align itself with an existing 9 research-based school improvement model or establish an affilia- 10 tion for providing assistance to the school with a college or 11 university located in this state. 12 (d) The school shall be closed. 13 (13) (12) The department shall evaluate the school accred- 14 itation program and the status of schools under this section and 15 shall submit an annual report based upon the evaluation to the 16 senate and house committees that have the responsibility for edu- 17 cation legislation. The report shall address the reasons each 18 unaccredited school is not accredited and shall recommend legis- 19 lative action that will result in the accreditation of all public 20 schools in this state. 21 Enacting section 1.
