HOUSE BILL No. 5722


     March 31, 1998, Introduced by Reps. Schroer, Martinez, Baird, Kelly, Mans, Brater and Emerson and referred to the Committee on Appropriations.


        A bill to amend 1976 PA 451, entitled

   "The revised school code,"

   by amending section 1211c (MCL 380.1211c), as amended by 1994 PA

   344; and to repeal acts and parts of acts.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1211c.  For 1994 through 1996, a  A school district

 2    may levy, in addition to the millage authorized under section

 3    1211, not more than 3 additional mills for enhancing operating

 4    revenue if approved by the school electors at an election held

 5    after 1993.  The question of levying mills authorized under this

 6    section shall be presented to school electors as a separate ques-

 7    tion and identified as being for enhancement of operating

 8    revenue.  A school district that is not a school district

 9    described in section  20(12) or (13)  20(8) OR (9) of the state

10    school aid act of 1979,  being section 388.1620 of the Michigan

 1    Compiled Laws  MCL 388.1620, shall not levy any millage under

 2    this section that was approved by the school electors after

 3    September 30, 1994, unless the school district levies, for the

 4    same tax year, the maximum number of mills under section 1211

 5    that does not exceed the limitations imposed by section 1211(3).

 6         Enacting section 1.  Section 705 of the revised school code,

 7    1976 PA 451, MCL 380.705, is repealed.
