HOUSE BILL No. 5846 May 12, 1998, Introduced by Reps. A bill to provide financial encouragement to certain insti- tutions of higher education to establish and operate on-site day care for the children of students who are attending the institu- tion; to establish the duties of certain officials and institu- tions; and to provide penalties and remedies. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "college students' children's day care act". 3 Sec. 2. For purposes of this act: 4 (a) "Child" means an individual under 12 years of age who is 5 the legal dependent of a student of an institution of higher 6 education. 7 (b) "Full-time" means not less than 30 hours per week. 8 (c) "Institution of higher education" or "institution" means 9 a public, private, or nonpublic education institution within the 03046'97 TLG 2 1 state authorized by law to provide a program of education beyond 2 the high school level. 3 (d) "On-site" means a location not more than 1/2 mile from 4 an institution of higher education. 5 (e) "Semester" means semester or semester equivalent, 6 including a summer semester. 7 (f) "Student" does not include tenured or tenure-track 8 faculty. Student includes an individual attending the institu- 9 tion part-time or full-time. 10 Sec. 3. (1) Funds appropriated by the legislature to sup- 11 port the establishment and operation of on-site day care for the 12 children of students of institutions of higher education shall be 13 allocated substantially as provided in this section. 14 (2) For each child of a student of the institution of higher 15 education that received full-time on-site day care, the institu- 16 tion shall receive $500.00 per semester in addition to other 17 money the institution receives from the state. 18 (3) The institution shall annually report the number of 19 children described in subsection (2) to the state board of educa- 20 tion, the department of education, and the standing appropria- 21 tions committees of both houses of the legislature not later than 22 December 15 in a manner prescribed by the department of education 23 to be eligible for payment under this act the following year. 24 Sec. 4. An institution of higher education that inaccu- 25 rately reports or fails to report under section 3 shall be ineli- 26 gible for payment under this act for the year in which the 27 inaccurate report or no report was received. 03046'97
