A bill to require the registration of certain electricity generators in this state; to prescribe the powers and duties of certain state agencies and officials; and to prescribe penalties and civil sanctions and provide remedies. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Commission" means the Michigan public service commis- 3 sion in the department of consumer and industry services. 4 (b) "Electricity generator" or "generator" means a person 5 having generating capability in this state to produce at least 1 6 megawatt of electricity. 7 (c) "Megawatt" means 1,000,000 watts. 8 (d) "Person" means an individual, partnership, corporation, 9 association, governmental entity, or other legal entity. 06059'98 * SAT 2 1 Sec. 2. (1) No later than 30 days after the effective date 2 of this act, a generator shall register with the commission. The 3 registration shall include all of the following information: 4 (a) The name of the electricity generator. 5 (b) The physical address and telephone number of the 6 generator's principal office. 7 (c) If the principal office of the generator is not located 8 in this state, the address and telephone number of the registered 9 office and the name and telephone number of the registered agent 10 authorized to receive service of process in this state. 11 (d) The specific location and rated capacity of each gener- 12 ating facility in this state owned or operated by the generator. 13 (2) An electricity generator shall notify the commission of 14 any changes that occur regarding the information required under 15 subsection (1). 16 Sec. 3. The registration is effective immediately upon 17 filing with the commission. 18 Sec. 4. The commission shall maintain a list of all regis- 19 tered generators and the list shall be available to any person 20 upon request. 21 Sec. 5. If after notice and hearing the commission finds a 22 person has violated this act, the commission shall order remedies 23 and penalties to protect and make whole any persons who have suf- 24 fered an economic loss as a result of the violation, including, 25 but not limited to, 1 or more of the following: 26 (a) The person to pay a fine for the first offense of not 27 less than $1,000.00 nor more than $20,000.00 per day that the 06059'98 * 3 1 person is in violation of this act, and for each subsequent 2 offense, a fine of not less than $2,000.00 nor more than 3 $40,000.00 per day. 4 (b) A refund to the customers of any collected excessive 5 rates. 6 (c) Cease and desist orders. 7 (d) If the person is certified or registered under this or 8 any other act, revoke the person's certificate or registration. 06059'98 * Final page.
