A bill to amend 1994 PA 295, entitled "Sex offenders registration act," by amending sections 4 and 6 (MCL 28.724 and 28.726), section 6 as amended by 1996 PA 494. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 4. (1) Registration of an individual under this act 2 shall proceed as provided in this section. 3 (2) For an individual convicted of a listed offense on or 4 before October 1, 1995 who on or before October 1, 1995isWAS 5 sentenced for that offense,hasHAD a disposition entered for 6 that offense, orisWAS assigned to youthful trainee status for 7 that offense, the following shallregisterHAVE REGISTERED the 8 individual by December 31, 1995: 9 (a) If the individualisWAS on probation for the listed 10 offense, the individual's probation officer. 06319'98 a TJS 2 1 (b) If the individualisWAS committed to jail for the 2 listed offense, the sheriff or his or her designee. 3 (c) If the individualisWAS under the jurisdiction of the 4 department of corrections for the listed offense, the department 5 of corrections. 6 (d) If the individualisWAS on parole for the listed 7 offense, the individual's parole officer. 8 (e) If the individualisWAS within the jurisdiction of 9 the juvenile division of the probate court or the department of 10 social services pursuant to an order of disposition for the 11 listed offense, the juvenile division of the probate court or the 12 department of social services. 13 (3) For an individual convicted of a listed offense on or 14 before October 1, 1995: 15 (a) If the individual is sentenced for that offense after 16 October 1, 1995 or assigned to youthful trainee status after 17 October 1, 1995, the probation officer shall register the indi- 18 vidual before sentencing or assignment. 19 (b) If the individual's probation or parole is transferred 20 to this state after October 1, 1995, the probation or parole 21 officer shall register the individual within 14 days after the 22 transfer. 23 (c) If the individual is placed within the jurisdiction of 24 the juvenile division of the probate court or the department of 25 social services pursuant to an order of disposition entered after 26 October 1, 1995, the juvenile division of the probate court shall 06319'98 a 3 1 register the individual before the order of disposition is 2 entered. 3 (4) For an individual convicted of a listed offense in this 4 state after October 1, 1995, the individual shall register before 5 sentencing, entry of the order of disposition, or assignment to 6 youthful trainee status. The probation officer or the juvenile 7 division of the probate court shall give the individual the reg- 8 istration form after the individual is convicted, shall explain 9 the duty to register, SHALL INFORM THE INDIVIDUAL OF THE REQUIRE- 10 MENT THAT REGISTRATION UNDER THIS ACT WILL BE PLACED ON THE 11 INDIVIDUAL'S DRIVER LICENSE AS PRESCRIBED UNDER SECTION 310 OF 12 THE MICHIGAN VEHICLE CODE, 1949 PA 300, MCL 257.310, and shall 13 accept the completed registration for processing pursuant to 14 section 6. 15 (5) For an individual convicted of a listed offense in 16 another state or country after October 1, 1995, the individual 17 shall register with the local law enforcement agency, or the 18 state police or the sheriff's department within 14 days after 19 becoming domiciled or temporarily residing in this state. 20 Sec. 6. (1) The officer, court, or agency registering an 21 individual or receiving or accepting a registration under section 22 4 or receiving notice under section 5(1) shall provide the indi- 23 vidual with a copy of the registration or notification at the 24 time of registration or notice. 25 (2) The officer, court, or agency registering an individual 26 or receiving or accepting a registration under section 4 or 27 notified of an address change under section 5(1) shall forward 06319'98 a 4 1 the registration or notification to the department by the law 2 enforcement information network AND THE SECRETARY OF STATE within 3 3 business days after registration or notification. 4 Enacting section 1.
