SENATE BILL NO. 829 December 3, 1997, Introduced by Senators EMMONS and HOFFMAN and referred to the Committee on Appropriations. A bill to amend 1971 PA 140, entitled "State revenue sharing act of 1971," by amending section 3 (MCL 141.903), as amended by 1980 PA 275. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3. (1) "Population" for the purpose of distributing 2 revenues among cities, villages, townships, and counties means 3 population according to the last and each succeeding statewide 4 federal census, or a special statewide census as provided by law, 5 whichever is later. Corrections to the statewide federal census 6 that are published by the bureau of the census, United States 7 department of commerce, and that occur during the period July 1, 8 and ending June 30, shall become effective for the purpose of 9 revenue distributions on the next July 1. Fifty percent of the 10 total number of persons who are wards,AND patients, orAND 11 NO PERSONS WHO ARE convicts committed to or domiciled in a city, 03082'97 RJA 2 1 village, or township institution located outside the boundaries 2 of the city, village, or township or committed to or domiciled in 3 a county, state, or federal tax-supported institution, if the 4 persons were included in the federal census, or any special 5 census as provided by law, shall be excluded from the 6 computation. The population of a township is its population out- 7 side the corporate limits of villages in the township. The popu- 8 lation data used in determining distributions under this act in a 9 year in which a federal decennial statewide census, federal 10 mid-decade statewide census, or special statewide census provided 11 by law is conductedshall becomeBECOMES effective for distri- 12 butions made on and after October 1 of the year for which the 13 respective census is conducted. Once the official population 14 data from a federal decennial statewide census, federal 15 mid-decade statewide census, or special statewide census provided 16 by law is certified and published, the department of management 17 and budget shall calculate any overpayment or underpayment made 18 to a local unit of government since the effective date of the 19 respective census and make adjustments in future distributions to 20 the local unit of government to correct these overpayments or 21 underpayments of revenue distributed pursuant to this act. 22 (2) "Rate" means a figure determined each May 15 by the 23 department of management and budget pursuant to this act from 24 applicable tax data for the preceding calendar year as reported 25 to it by the department of treasury and applicable to payments 26 made during the succeeding period of July 1 to June 30. 03082'97 Final page.
