SENATE BILL NO. 842


  January 14, 1998, Introduced by Senator SCHUETTE and 
       referred to the Committee on Local, Urban and State 
       Affairs.
     


        A bill to authorize the department of natural resources to

   convey certain state owned property in Clare county; to prescribe

   conditions for the conveyance; and to provide for disposition of

   the revenue from the conveyance.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1.  The department of natural resources, on behalf of

 2    the state, may convey to Garfield township, for consideration of

 3    $1.00, property under the jurisdiction of the department of natu-

 4    ral resources and located in Garfield township, Clare county,

 5    Michigan, and further described as follows:

 6         The South three quarters (S3/4) of the East Half (E/2) of

 7    the Southeast quarter (SE/4) of Section 3, Garfield Township,

 8    T17N, R6W, Clare County, Michigan

 9         Sec. 2.  The conveyance authorized by this act shall provide

10    for both of the following:

 1         (a) That the property shall be used exclusively for public

 2    purposes and that upon termination of that use or use for any

 3    other purpose, the state may reenter and repossess the property,

 4    terminating the grantee's estate in the property.

 5         (b) That if the grantee disputes the state's exercise of its

 6    right of reentry and fails to promptly deliver possession of the

 7    property to the state, the attorney general, on behalf of the

 8    state, may bring an action to quiet title to, and regain posses-

 9    sion of, the property.

10         Sec. 3.  The conveyance authorized by this act shall be by

11    quitclaim deed approved by the attorney general and shall convey

12    all rights held by the state to coal, oil, gas, and other miner-

13    als, excluding sand, gravel, clay, or other nonmetallic minerals

14    found on or under the property conveyed.

15         Sec. 4.  The revenue received under this act shall be depos-

16    ited in the state treasury and credited to the general fund.
